       AN ACT in relation to state aid payments to the Bethlehem central school
         district
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  For  payments  to  be made for the two thousand nine--two
    2  thousand ten school year  to  the  Bethlehem  central  school  district,
    3  notwithstanding  any  failure  to  comply  with  the  filing  provisions
    4  contained in paragraph a of subdivision 5 of section 3604 of the  educa-
    5  tion  law,  the  education department is hereby directed to consider the
    6  information filed by the school district and used to produce the  school
    7  aid  computer  listing  produced by the commissioner of education on May
    8  15, 2010 pursuant to paragraph b of subdivision 21 of section 305 of the
    9  education law or on file with the department and  used  to  produce  the
   10  school  aid  computer  run  produced by the commissioner of education in
   11  support of the enacted budget for the  two  thousand  ten--two  thousand
   12  eleven  state  fiscal year as a valid and proper filing of the Bethlehem
   13  central school district, and the commissioner of education shall compute
   14  a supplemental payment equal to the apportionment pursuant  to  subdivi-
   15  sion  9  of section 3602 of the education law computed by using the data
   16  on file with the department and used to produce the school aid  computer
   17  listing  produced  by  the  commissioner  of education in support of the
   18  enacted budget for the  two  thousand  ten--two  thousand  eleven  state
   19  fiscal year. Notwithstanding any other provision of law to the contrary,
   20  such  supplemental payment shall be computed using data on file with the
   21  department and used to produce the school aid computer run  produced  by
   22  the  commissioner  of education in support of the enacted budget for the
   23  two thousand ten--two thousand eleven state fiscal year, and  shall  not
   24  be subject to change thereafter.
   25    S 2. This act shall take effect immediately.
