A BILL
To enact section 3321.30 of the Revised Code to 1
require parents of students enrolled in school 2
districts rated continuous improvement or lower to 3
attend a parent-teacher conference.4

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That section 3321.30 of the Revised Code be 5
enacted to read as follows:6

Sec. 3321.30.  (A) As used in this section, "parent" means 7
either of the natural or adoptive parents of a student, except 8
under the following conditions:9

       (1) When the marriage of the natural or adoptive parents of 10
the student has been terminated by a divorce, dissolution of 11
marriage, or annulment or the natural or adoptive parents of the 12
student are living separate and apart under a legal separation 13
decree and the court has issued an order allocating the parental 14
rights and responsibilities with respect to the student, "parent" 15
means the residential parent as designated by the court except 16
that "parent" means either parent when the court issues a shared 17
parenting decree.18

       (2) When a court has granted temporary or permanent custody 19
of the student to an individual or agency other than either of the 20
natural or adoptive parents of the student, "parent" means the 21
legal custodian of the student.22

       (3) When a court has appointed a guardian for the student, 23
"parent" means the guardian of the student.24

       (4) When the student is the subject of a power of attorney 25
executed under sections 3109.51 to 3109.62 of the Revised Code, 26
"parent" means the grandparent designated as attorney in fact 27
under the power of attorney. When the student is the subject of a 28
caretaker authorization affidavit executed under sections 3109.65 29
to 3109.73 of the Revised Code, "parent" means the grandparent who 30
executed the affidavit.31

       (B) This section applies to any city, exempted village, or 32
local school district in each school year in which the school 33
district ratings published under section 3302.03 of the Revised 34
Code after the first day of July of that school year declare the 35
district to be in need of continuous improvement, under an 36
academic watch, or in a state of academic emergency.37

       (C) The parent of each student enrolled in a school district 38
to which this section applies shall attend, prior to the 39
thirty-first day of December of the school year, at least one 40
parent-teacher conference held by the school the student attends 41
to meet the student's teachers. The conference shall provide an 42
opportunity for the parent and the student's teachers to establish 43
expectations of the student for the school year, discuss the 44
student's performance at school, and foster effective 45
communication. In the case of a parent who has more than one child 46
enrolled in the district, the requirement of this division shall 47
apply separately with respect to each of the parent's children so 48
enrolled.49

        (D) The board of education of each school district to which 50
this section applies shall impose a fine of fifty dollars on each 51
parent who fails to comply with division (C) of this section. In 52
the case of a parent who has more than one child enrolled in the 53
district, the board shall impose a separate fine of fifty dollars 54
for each child for whom the parent fails to comply with that 55
division. The board shall send the parent written notification of 56
the fine. The notification shall inform the parent of the 57
following:58

       (1) The amount of the fine, methods of payment, and the 59
deadline for payment;60

       (2) The procedures adopted under division (F) of this section 61
for showing good cause as to why the parent was unable to comply.62

        (E) The board shall notify parents of students enrolled in 63
the district of the requirements of divisions (C) and (D) of this 64
section. To the extent possible, the notification shall be 65
provided prior to the opening day of school.66

       (F) The board shall adopt a policy establishing procedures by 67
which a parent may appeal the fine imposed under division (D) of 68
this section. The policy shall require the board to waive the fine 69
for any parent who shows good cause as to why the parent was 70
unable to comply with division (C) of this section.71

       (G) The board shall use all fines collected under this 72
section solely to pay the costs of establishing and operating 73
mentoring programs for students or other volunteer programs.74
