A BILL
To amend sections 153.013 and 5525.26 and to enact 1
section 3318.101 of the Revised Code to require 2
contractors for certain municipally-administered 3
construction projects and for certain 4
state-assisted classroom facilities projects to 5
comply with certain municipal ordinances regarding 6
the use of local residents and businesses to 7
perform the work.8


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 153.013 and 5525.26 be amended and 9
section 3318.101 of the Revised Code be enacted to read as 10
follows:11

       Sec. 153.013.  If a project for the construction, 12
alteration, or other improvement of a building or structure is 13
administered by the director of administrative services or, by 14
another state agency, or by a municipal corporation authorized to 15
administer a project under this chapter, if the project is 16
located in a municipal corporation with a population of at least 17
four hundred thousand that is in a county with a population of at 18
least one million two hundred thousand, and if a political 19
subdivision contributes at least one hundred thousand dollars to 20
the project, then a contractor for the project shall comply with 21
regulations or ordinances of the political subdivision that are 22
in effect before July 1, 2009, and that specifically relate to 23
the employment of residents and local businesses of the political 24
subdivision in the performance of the work of the project, and 25
such. Those ordinances or regulations shall be included by 26
reference unambiguously in the contract between the administering 27
state agency or municipal corporation and the contractor for the 28
project.29

       Sec. 3318.101.  (A) As used in this section, "qualifying 30
project" means a project undertaken by a city, exempted village, 31
or local school district under this chapter, or a project 32
undertaken by a joint vocational school district under sections 33
3318.40 to 3318.45 of the Revised Code, for which the district's 34
share of the basic project cost is at least one hundred thousand 35
dollars.36

       (B) This section applies to any school district in which the 37
major part of the district's territory is located in a municipal 38
corporation with a population of at least four hundred thousand 39
that is in a county with a population of at least one million two 40
hundred thousand.41

       (C) When a school district to which this section applies 42
enters into a construction contract for a qualifying project under 43
section 3318.10 of the Revised Code on or after the effective date 44
of this section, the contract shall require the contractor to 45
comply with any regulations or ordinances of the municipal 46
corporation in which the major part of the district's territory is 47
located that were in effect before July 1, 2009, and that 48
specifically relate to the employment of residents and local 49
businesses of the municipal corporation for projects involving the 50
construction, alteration, or other improvement of a building or 51
structure. Those regulations or ordinances shall be included by 52
reference unambiguously in the contract between the district and 53
the contractor.54

       Sec. 5525.26.  Except as provided in federal law, if a 55
project for the construction, reconstruction, or other improvement 56
to a road or highway is administered by the department of 57
transportation or any local public authority authorized under 58
division (C)(D) of section 5501.03 of the Revised Code, if the 59
project is located in a municipal corporation with a population of 60
at least four hundred thousand that is in a county with a 61
population of at least one million two hundred thousand, and if 62
the project is funded with at least one hundred thousand dollars 63
from a political subdivision, then a contractor for the project 64
shall comply with regulations or ordinances of the political 65
subdivision that are in effect before July 1, 2009, and that 66
specifically relate to the employment of residents and local 67
businesses of the political subdivision in the performance of the 68
work of the project, and such. Those ordinances or regulations 69
shall be included by reference unambiguously in the contract 70
between the department of transportation or public authority and 71
the contractor for the project.72

       Section 2.  That existing sections 153.013 and 5525.26 of the 73
Revised Code are hereby repealed.74
