A BILL

To amend section 2949.25 of the Revised Code to

require the Governor and the Director of

Rehabilitation and Correction to be present at the

execution of a death sentence.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1.  That section 2949.25 of the Revised Code be	5
amended to read as follows:	6

Sec. 2949.25.  (A) AtThe governor and the director of	7
rehabilitation and correction shall be present at the execution of	8
a death sentence,executed in accordance with section 2949.22 of	9
the Revised Code. In addition to the governor and the director of	10
rehabilitation and correction, only the following persons may be	11
present at the execution of a death sentence:	12

(1) The warden of the state correctional institution in which	13
the sentence is executed or a deputy warden, any other person	14
selected by the director of rehabilitation and correction to	15
ensure that the death sentence is executed, any persons necessary	16
to execute the death sentence by lethal injection, and the number	17
of correction officers that the warden thinks necessary;	18

(2) The sheriff of the county in which the prisoner was tried	19
and convicted;	20

(3) The director of rehabilitation and correction, or the	21
director's agent;	22

(4) Physicians of the state correctional institution in which	23
the sentence is executed;	24

(5)(4) The clergyperson in attendance upon the prisoner, and	25
not more than three other persons, to be designated by the	26
prisoner, who are not confined in any state institution;	27

(6)(5) Not more than three persons to be designated by the	28
immediate family of the victim;	29

(7)(6) Representatives of the news media as authorized by the	30
director of rehabilitation and correction.	31

(B) The director shall authorize at least one representative	32
of a newspaper, at least one representative of a television	33
station, and at least one representative of a radio station to be	34
present at the execution of the sentence under division (A)(7)(6)	35
of this section.	36

Section 2.  That existing section 2949.25 of the Revised Code	37
is hereby repealed.	38
