A BILL
To amend section 4507.13 of the Revised Code to allow 1
a notation on a driver's license that the licensee 2
has suffered a traumatic brain injury.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4507.13 of the Revised Code be 4
amended to read as follows:5

       Sec. 4507.13.  (A) The registrar of motor vehicles shall 6
issue a driver's license to every person licensed as an operator 7
of motor vehicles other than commercial motor vehicles. No person 8
licensed as a commercial motor vehicle driver under Chapter 4506. 9
of the Revised Code need procure a driver's license, but no person 10
shall drive any commercial motor vehicle unless licensed as a 11
commercial motor vehicle driver. 12

       Every driver's license shall display on it the distinguishing 13
number assigned to the licensee and shall display the licensee's 14
name and date of birth; the licensee's residence address and 15
county of residence; a color photograph of the licensee; a brief 16
description of the licensee for the purpose of identification; a 17
facsimile of the signature of the licensee as it appears on the 18
application for the license; a notation, in a manner prescribed by 19
the registrar, indicating any condition described in division 20
(D)(3) of section 4507.08 of the Revised Code to which the 21
licensee is subject; a notation, in a manner prescribed by the 22
registrar, indicating that the licensee has suffered a traumatic 23
brain injury, if the licensee requests the notation and provides 24
documentation of the injury as required by the registrar; if the 25
licensee has executed a durable power of attorney for health care 26
or a declaration governing the use or continuation, or the 27
withholding or withdrawal, of life-sustaining treatment and has 28
specified that the licensee wishes the license to indicate that 29
the licensee has executed either type of instrument, any symbol 30
chosen by the registrar to indicate that the licensee has executed 31
either type of instrument; on and after October 7, 2009, if the 32
licensee has specified that the licensee wishes the license to 33
indicate that the licensee is a veteran, active duty, or 34
reservist of the armed forces of the United States and has 35
presented a copy of the licensee's DD-214 form or an equivalent 36
document, any symbol chosen by the registrar to indicate that 37
the licensee is a veteran, active duty, or reservist of the 38
armed forces of the United States; and any additional 39
information that the registrar requires by rule. No license shall 40
display the licensee's social security number unless the licensee 41
specifically requests that the licensee's social security number 42
be displayed on the license. If federal law requires the 43
licensee's social security number to be displayed on the license, 44
the social security number shall be displayed on the license 45
notwithstanding this section. 46

       The driver's license for licensees under twenty-one years of 47
age shall have characteristics prescribed by the registrar 48
distinguishing it from that issued to a licensee who is twenty-one 49
years of age or older, except that a driver's license issued to a 50
person who applies no more than thirty days before the applicant's 51
twenty-first birthday shall have the characteristics of a license 52
issued to a person who is twenty-one years of age or older. 53

       The driver's license issued to a temporary resident shall 54
contain the word "nonrenewable" and shall have any additional 55
characteristics prescribed by the registrar distinguishing it from 56
a license issued to a resident. 57

       Every driver's or commercial driver's license displaying a 58
motorcycle operator's endorsement and every restricted license to 59
operate a motor vehicle also shall display the designation 60
"novice," if the endorsement or license is issued to a person who 61
is eighteen years of age or older and previously has not been 62
licensed to operate a motorcycle by this state or another 63
jurisdiction recognized by this state. The "novice" designation 64
shall be effective for one year after the date of issuance of the 65
motorcycle operator's endorsement or license. 66

       Each license issued under this section shall be of such 67
material and so designed as to prevent its reproduction or 68
alteration without ready detection and, to this end, shall be 69
laminated with a transparent plastic material. 70

       (B) Except in regard to a driver's license issued to a person 71
who applies no more than thirty days before the applicant's 72
twenty-first birthday, neither the registrar nor any deputy 73
registrar shall issue a driver's license to anyone under 74
twenty-one years of age that does not have the characteristics 75
prescribed by the registrar distinguishing it from the driver's 76
license issued to persons who are twenty-one years of age or 77
older. 78

       (C) Whoever violates division (B) of this section is guilty 79
of a minor misdemeanor. 80

       Section 2. That existing section 4507.13 of the Revised Code 81
is hereby repealed.82
