A BILL
To enact section 3701.67 of the Revised Code to 1
create the Ohio Bed Bug Infestation Task Force to 2
study bed bug infestation in Ohio.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3701.67 of the Revised Code be 4
enacted to read as follows:5

       Sec. 3701.67. (A) There is hereby created the Ohio bed bug 6
infestation task force. The task force shall consist of the 7
following fifteen members:8

       (1) The director of health or the director's designee, who 9
shall serve as the task force's chairperson;10

       (2) An employee of the department of aging, appointed by the 11
director of aging;12

       (3) An employee of the department of agriculture, appointed 13
by the director of agriculture;14

       (4) An employee of the department of commerce, appointed by 15
the director of commerce;16

       (5) An employee of the department of development, appointed 17
by the director of development;18

       (6) An employee of the department of job and family services, 19
appointed by the director of job and family services;20

        (7) One individual representing the interests of each of the 21
following constituencies, appointed by the governor with the 22
advice and consent of the senate:23

       (a) The pest control industry;24

       (b) Boards of health of city or general health districts;25

       (c) Environmental protection groups;26

       (d) Tenants of residential dwelling units that are rented or 27
leased;28

       (e) Colleges or universities located in this state;29

        (f) The lodging industry;30

        (g) The pesticide production and manufacturing industry.31

       (8) Two individuals representing the interests of owners of 32
residential dwelling units that are rented or leased, appointed by 33
the governor with the advice and consent of the senate.34

       Appointments shall be made not later than sixty days after 35
the effective date of this section. Members shall serve at the 36
pleasure of their appointing authorities. Vacancies shall be 37
filled in the manner provided for original appointments.38

       Members shall serve without compensation, except to the 39
extent that serving on the task force is considered part of their 40
regular duties of employment.41

       (B) The task force shall meet at the call of the chairperson. 42
During the period before submission of the report required by 43
division (C) of this section, the task force shall meet at least 44
once each calendar year quarter beginning with the quarter in 45
which appointments are made under division (A) of this section. 46
After submission of the report, the task force shall meet when 47
determined to be necessary by the chairperson. 48

       The department of health shall provide meeting space, staff 49
services, and technical assistance required by the task force in 50
carrying out its duties.51

       (C) The task force shall study the problem of bed bug 52
infestations in this state and submit a report to the governor 53
and, in accordance with section 101.68 of the Revised Code, the 54
general assembly. At a minimum, the report shall contain all of 55
the following:56

       (1) An analysis of the impact that bed bug infestations have 57
on vulnerable populations;58

       (2) An analysis of the roles and responsibilities 59
governmental entities have assumed in controlling bed bugs, the 60
procedures governmental entities employ to control bed bugs, and 61
the deficiencies that may exist with respect to the roles and 62
responsibilities assumed and the procedures employed;63

       (3) A description of best practices used to control bed bugs 64
in communities in this state and other jurisdictions;65

        (4) Subject to division (D) of this section, recommendations 66
regarding all of the following:67

       (a) How to most effectively monitor and track bed bug 68
infestations;69

       (b) How to most effectively and safely use chemicals or other 70
substances to control bed bugs;71

       (c) How boards of health of city or general health districts 72
can most effectively assist statewide and community efforts, if 73
any, to control bed bugs, including the boards' roles in 74
enforcement of laws and ordinances;75

        (d) Which governmental entities should be required to enforce 76
laws and ordinances pertaining to controlling bed bug 77
infestations;78

       (e) Whether additional legislation needs to be enacted to 79
control bed bug infestations.80

       The report shall be submitted not later than one year after 81
appointments to the task force are made under division (A) of this 82
section.83

        (D) For purposes of fulfilling the responsibility described 84
in division (C)(4)(b) of this section, the task force shall 85
consult with federal officials regarding the chemicals and other 86
substances that are available and safe for use in controlling bed 87
bugs. If appropriate, the task force shall assist the director of 88
agriculture in applying to the administrator of the United States 89
environmental protection agency for an emergency exemption from 90
the provisions of the "Federal Insecticide, Fungicide, and 91
Rodenticide Act," 7 U.S.C. 136 et seq., authorized under 7 U.S.C. 92
136p.93

       (E) Sections 101.82 to 101.87 of the Revised Code do not 94
apply to the task force.95
