                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Exempts wave energy facility or project in territorial sea from
licensing process for hydroelectric facilities if wave energy
facility or project is subject to project review and approval by
Land Conservation and Development Commission for compliance with
Oregon Ocean Resources Management Program and Coastal Zone
Management Act of 1972. Repeals existing wave energy facility
exemptions.

                        A BILL FOR AN ACT
Relating to wave energy exemption from hydroelectric standards;
  creating new provisions; amending section 4, chapter 152,
  Oregon Laws 2011; and repealing ORS 543.014.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2013 Act is added to and made
a part of ORS chapter 543. + }
  SECTION 2. { +  (1) As used in this section, 'wave energy'
means the generation of power through converting the kinetic
energy of waves in the territorial sea into electricity.
  (2) This chapter and ORS chapter 543A do not apply to a wave
energy facility or project that is subject to review and approval
by the Land Conservation and Development Commission under ORS
196.405 to 196.515. + }
  SECTION 3. Section 4, chapter 152, Oregon Laws 2011, is amended
to read:
   { +  Sec. 4. + } Section 2   { - of this 2011 Act - }  { + ,
chapter 152, Oregon Laws 2011, + } is repealed January 2,
 { - 2022 - }  { +  2014 + }.
  SECTION 4.  { + ORS 543.014 is repealed. + }
  SECTION 5.  { + Section 2 of this 2013 Act applies to wave
energy facilities and projects for which the Land Conservation
and Development Commission takes final action under ORS 196.405
to 196.515 on a facility or project application on or after the
effective date of this 2013 Act. + }
  SECTION 6.  { + Notwithstanding the amendments to section 4,
chapter 152, Oregon Laws 2011, by section 3 of this 2013 Act, the
Department of State Lands may grant an exemption as described
under section 2, chapter 152, Oregon Laws 2011, on or after
January 2, 2014, for any application under section 2, chapter
152, Oregon Laws 2011, pending before the department on January
2, 2014. + }
