                     SENATE MINORITY REPORT
                          AMENDMENTS TO
             A-ENGROSSED SENATE JOINT RESOLUTION 44

                           February 19

President Courtney:
  A minority of your Committee on Rules, to whom was referred
A-engrossed Senate Joint Resolution 44, having had the same under
consideration, respectfully reports it back with the
recommendation that it be adopted with the following amendments:

  On page 1 of the printed A-engrossed joint resolution, delete
lines 3 through 26 and delete page 2 and insert:
  '  { +  PARAGRAPH 1. + } The Constitution of the State of
Oregon is amended by creating a new section 46 to be added to and
made a part of Article I, such section to read:
  '  { +  SECTION 46. + }  { + (1) When a criminal defendant is
convicted of a felony and sentenced to a term of imprisonment
that exceeds one year, the sentencing court may not authorize,
and the criminal defendant may not be granted, a reduction in the
term of imprisonment for good behavior while imprisoned that
exceeds 15 percent of the term imposed.
  ' (2) As used in this section, 'good behavior' means:
  ' (a) Appropriate institutional behavior; and
  ' (b) Participation in, or the completion of, an educational
program. + }

  '  { +  PARAGRAPH 2. + }  { + The amendment proposed by this
resolution shall be submitted to the people for their approval or
rejection at the next regular general election held throughout
this state. + } ' .
