AN ACT

Providing for the lapsing of appropriations for the Legislative

2

Department.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

Section 1.  Short title.

6

This act shall be known and may be cited as the Lapse of

7

Appropriations Act.

8

Section 2.  Determination.

9

Within ten days of the effective date of this section, the

10

State Treasurer shall determine the amounts of appropriations

11

for the Legislative Department under the general appropriation

12

acts for all fiscal periods prior to July 1, 2008, which remain

13

unexpended, uncommitted or unencumbered as of the effective date

14

of this section.

Section 3.  Lapses of Legislative Department amounts.

(a)  Immediate automatic lapse.--Any amounts remaining of

17

appropriations for the Legislative Department enacted in general

18

appropriation acts prior to July 1, 2008, which remain

unexpended, uncommitted or unencumbered as of the effective date

2

of this section, except for $60,000,000 of the remaining

3

amounts, are hereby automatically lapsed.

(b)  Future automatic lapse.--Any amounts remaining of

5

appropriations for the Legislative Department enacted in a

6

general appropriation act for a fiscal year, which are

7

unexpended, uncommitted or unencumbered as of June 30 of the

8

fiscal year or as of the date on which the Governor signs the

9

general appropriation act for the subsequent fiscal year,

10

whichever is later, shall automatically lapse as of that date. 

11

Section 4.  Applicability.

12

Section 3(b) shall apply to the fiscal year beginning July 1,

13

2009, and each fiscal year thereafter.

14

Section 5.  Effective date.

15

This act shall take effect immediately.
