AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, in firearms and other dangerous

3

articles, further providing for license fees.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 6109(h) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 6109.  Licenses.

9

(h)  Fee.--

11

(1)  [In addition to fees described in paragraphs (2)(ii)

12

and (3), the fee for a license to carry a firearm is $19.

13

This includes] Except as otherwise provided in subsection

14

(m.1), the total fee for a license to carry a firearm shall

15

be $25. This fee shall include all of the following:

16

(i)  A renewal notice processing fee of $1.50.

17

(ii)  [An administrative fee of $5 under section

18

14(2) of] Any fee under the act of July 6, 1984 (P.L.614,

No.127), known as the Sheriff Fee Act.

2

(iii)  The fees described in paragraphs (2)(ii),

3

(2.1) and (3).

(2)  (i)  The Pennsylvania Commission on Crime and

5

Delinquency shall implement, within five years of the

6

effective date of this paragraph, a system in conjunction

7

with the Pennsylvania State Police and the Pennsylvania

8

Sheriffs' Association to standardize and modernize the

9

process of issuing licenses to carry firearms. Upon

10

implementation of the system under this paragraph, the

11

Pennsylvania Commission on Crime and Delinquency shall

12

publish notice thereof in the Pennsylvania Bulletin.

13

(ii)  An additional temporary fee of $5 shall be

14

remitted by the sheriff to the Firearms License to Carry

15

Modernization Account, which is hereby established as a

16

special restricted receipt account within the General

17

Fund of the State Treasury. Moneys and investment income

18

in the account shall be awarded as grants to sheriffs to

19

implement the system, including grants to reimburse

20

sheriffs for expenses incurred prior to the effective

21

date of this paragraph.

22

(iii)  Moneys credited to the account and any

23

investment income accrued are hereby appropriated on a

24

continuing basis to the Pennsylvania Commission on Crime

25

and Delinquency. The commission shall establish

26

procedures related to the application process for and

27

distribution of funds to sheriffs under this paragraph.

28

Notwithstanding the provisions of subparagraph (ii), the

29

commission may withhold annually an amount not exceeding

30

5% of the funds credited to the account in that fiscal

year for the cost to implement the system under

2

subparagraph (i) and for administrative costs directly

3

related to the responsibilities of the commission under

4

this paragraph.

(iv)  This paragraph shall expire [five years after

6

its effective date] May 8, 2011. Any surplus funds

7

remaining in the account established in subparagraph (ii)

8

[at such time] on that date shall [lapse into the

9

General] be transferred to the Sheriffs' Equipment and

10

Training Fund established in paragraph (2.1).

11

(2.1)  (i)  The Pennsylvania Commission on Crime and

12

Delinquency shall create a program, in conjunction with

13

the Pennsylvania Sheriffs' Association, to provide for

14

grants to sheriffs for law enforcement equipment and

15

training.

16

(ii)  On or after May 8, 2011, an additional fee of

17

$5 shall be remitted by the sheriff to the Sheriffs'

18

Equipment and Training Fund, which is hereby established

19

as a special restricted receipt account within the State

20

Treasury. Moneys and investment income in the account

21

shall be awarded as grants to sheriffs for law

22

enforcement equipment and training.

23

(iii)  Moneys credited to the account and any

24

investment income accrued are hereby appropriated on a

25

continuing basis to the Pennsylvania Commission on Crime

26

and Delinquency. The commission shall establish

27

procedures related to the application process for and

28

distribution of funds to sheriffs under this paragraph.

29

Notwithstanding the provisions of subparagraph (ii), the

30

commission may withhold annually an amount not exceeding

5% of the funds credited to the account in that fiscal

2

year for administrative costs directly related to the

3

responsibilities of the commission under this paragraph.

(iv)  No grant shall be awarded under this paragraph

5

to a sheriff who:

6

(A)  except as otherwise provided in subsection

7

(m.1), sells or attempts to sell a license to carry a

8

firearm for a fee in excess of, or lower than, $25;

9

(B)  fails to send applications for renewal as

10

provided in subsection (f)(2); or

11

(C)  uses an application form other than the

12

uniform application prescribed by the Pennsylvania

13

State Police pursuant to subsection (c).

14

(3)  An additional fee of $1 shall be paid by the

15

applicant for a license to carry a firearm and shall be

16

remitted by the sheriff to the Firearms License Validation

17

System Account, which is hereby established as a special

18

restricted receipt account within the General Fund of the

19

State Treasury. The account shall be used for purposes under

20

subsection (l). Moneys credited to the account and any

21

investment income accrued are hereby appropriated on a

22

continuing basis to the Pennsylvania State Police.

23

(4)  [No] Except as otherwise provided under subsection

24

(m.1), no fee [other than that provided by this subsection or

25

the Sheriff Fee Act] in excess of, or lower than, $25 may be

26

assessed by the sheriff for the performance of any background

27

check made pursuant to this [act] section or the issuance of

28

a license to carry a firearm.

(5)  The fee is payable to the sheriff to whom the

30

application is submitted and is payable at the time of

application for the license.

(6)  Except for the administrative fee of $5 under

3

section 14(2) of the Sheriff Fee Act, all other fees shall be

4

refunded if the application is denied but shall not be

5

refunded if a license is issued and subsequently revoked.

(7)  [A] Except as otherwise provided under subsection

7

(m.1), any person who sells or attempts to sell a license to

8

carry a firearm for a fee in excess of [the amounts fixed

9

under this subsection], or lower than, $25 commits a summary

10

offense.
