AN ACT

Amending Title 65 (Public Officers) of the Pennsylvania

2

Consolidated Statutes, in ethics standards and financial

3

disclosure, providing for gift ban.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 65 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 1103.1.  Gift ban.

9

(a)  Gifts.--Except as otherwise provided for in this

10

section, no public officer or candidate for public office shall

11

receive, accept, take, seek or solicit any gift or other item of

12

economic value having either a fair market value or aggregate

13

actual cost greater than $25 from any lobbyist or principal of a

14

lobbyist in a calendar year, unless the person who provided the

15

gift or item of economic value received lawful consideration of

16

equal or greater value in return from the public officer or

17

candidate for public office who received, accepted, took, sought

18

or solicited the gift or item of economic value.

(b)  Hospitality.--Except as otherwise provided for in this

2

section, no public officer or candidate for public office shall

3

receive, accept, take, seek or solicit hospitality,

4

transportation or lodging having either a fair market value or

5

aggregate actual cost greater than $500 from any lobbyist or

6

principal of a lobbyist in a calendar year, unless the person

7

who provided the hospitality, transportation or lodging receives

8

lawful consideration of equal or greater value in return from

9

the public officer or candidate for public office who received,

10

accepted, took, sought or solicited the hospitality,

11

transportation or lodging.

(c)  Exception.--The prohibition in subsections (a) and (b)

13

shall not apply to the following:

14

(1)  Anything for which the public officer or candidate

15

for public office pays market value.

16

(2)  A contribution, as defined in section 1621 of the

17

act of June 3, 1937 (P.L.1333, No.320), known as the

18

Pennsylvania Election Code, lawfully made under that act.

19

(3)  Attendance at a fundraising event sponsored by a

20

political organization.

21

(4)  A gift from a relative.

22

(5)  Anything provided by an individual on the basis of a

23

personal friendship unless the public officer has reason to

24

believe, under the circumstances, the provision was due to

25

the official position or employment of the public officer.

26

(6)  A commercially reasonable loan evidenced in writing

27

with repayment due by a certain date made in the ordinary

28

course of the lender's business.

(7)  A contribution or other payments to a legal defense

30

fund established for the benefit of the public officer so

long as the contribution is lawfully made.

(8)  Pension and other benefits resulting from continued

3

participation in an employee welfare and benefits plan

4

maintained by a former employer.

5

(9)  Informational materials that are sent to the office

6

of the public officer in the form of books, articles,

7

periodicals, other written materials, audiotapes, videotapes

8

or other forms of communication.

9

(10)  Awards or prizes that are given to competitors in

10

contests or events open to the public, including random

11

drawings.

12

(11)  Honorary degrees and awards and associated travel,

13

food, refreshments and entertainment provided in the

14

presentation of the degrees and awards.

15

(12)  Training provided to a public officer if the

16

training is in the interest of the governmental entity. This

17

shall include food and refreshments furnished to all

18

attendees as an integral part of the training.

19

(13)  Educational mission including meetings with

20

government officials, either foreign or domestic, intended to

21

educate public officials on matters of public policy, to

22

which the public officer may be invited to participate along

23

with other Federal, State or local public officials and

24

community leaders.

25

(14)  Bequests, inheritances and other transfers at

26

death.

27

(15)  Anything paid for by the Federal, State or other

28

government or governmental entity under a government

29

contract.

30

(16)  A plague, trophy or other item that is

substantially commemorative in nature and that is extended

2

for presentation.

(17)  Donations of products from a Pennsylvania company

4

that are intended primarily for promotional purposes, such as

5

display or free distribution, and are of minimal value to any

6

individual recipient.

(d)  Definitions.--The following words and phrases when used

8

in this section shall have the meanings given to them in this

9

subsection:

10

"Public officer."  A public official, executive-level State

11

employee or public employee.

12

"Relatives."  An individual's aunt, brother, daughter,

13

daughter-in-law, father, father-in-law, first cousin,

14

granddaughter, grandfather, grandmother, grandson, great aunt,

15

great uncle, half brother, half sister, husband, mother, mother-

16

in-law, nephew, niece, sister, son, son-in-law, stepbrother,

17

stepdaughter, stepfather, stepmother, stepsister, stepson, uncle

18

or wife. This term shall include the father, mother, grandfather

19

or grandmother of the individual's spouse, fiancé or fiancée.

Section 2.  Section 1105(b)(7) of Title 65 is amended to

21

read:

§ 1105.  Statement of financial interests.

23

(b)  Required information.--The statement shall include the

25

following information for the prior calendar year with regard to

26

the person required to file the statement:

(7)  The name and address of the source and the amount of

29

any payment for or reimbursement of actual expenses for

30

transportation and lodging or hospitality received in

connection with public office or employment where such actual

2

expenses for transportation and lodging or hospitality exceed

3

[$650] $250 in an aggregate amount per year. This paragraph

4

shall not apply to expenses reimbursed by a governmental body

5

or to expenses reimbursed by an organization or association

6

of public officials or employees of political subdivisions

7

which the public official or employee serves in an official

8

capacity.
