AN ACT

Amending the act of August 26, 1971 (P.L.351, No.91), entitled

2

"An act providing for a State Lottery and administration

3

thereof; authorizing the creation of a State Lottery

4

Commission; prescribing its powers and duties; disposition of

5

funds; violations and penalties therefor; exemption of prizes

6

from State and local taxation and making an appropriation,"

7

authorizing the implementation of keno games at certain

8

retail liquor establishments; providing for collection of

9

revenues; imposing duties on the Bureau of Pennsylvania State

10

Lottery; establishing an advisory committee; imposing a keno

11

games tax; and making an appropriation.

12

The General Assembly of the Commonwealth of Pennsylvania

13

hereby enacts as follows:

14

Section 1.  The act of August 26, 1971 (P.L.351, No.91),

15

known as the State Lottery Law, is amended by adding a chapter

16

to read:

CHAPTER 4

KENO GAMES

19

Section 401.  Scope.

20

This chapter relates to keno games.

21

Section 402.  Definitions.

22

The following words and phrases when used in this chapter

shall have the meanings given to them in this section unless the

2

context clearly indicates otherwise:

3

"Advisory committee."  The Keno Games Advisory Committee

4

established in section 405.

5

"Applicant."  A licensed corporation which applies for a keno

6

license under this chapter.

7

"Bureau."  The Bureau of Pennsylvania State Lottery of the

8

Commonwealth.

9

"Department."  The Department of Revenue of the Commonwealth.

10

"Fund."  The State Lottery Fund.

11

"Gross income."  The total amount of cash, vouchers or tokens

12

collected for a keno game operated by a licensee, minus the

13

total value of coins and tokens won by a player.

14

"Keno."  A game of chance using 80 numbers in which 20 random

15

numbers are drawn and players may win cash prizes based on how

16

many numbers they match to the numbers randomly drawn by the

17

licensee.

18

"Keno license."  A license authorizing a licensed corporation

19

to conduct keno games in its licensed premises.

20

"Licensed corporation."  A corporation or other entity that

21

holds a retail liquor license under the act of April 12, 1951

22

(P.L.90, No.21), known as the Liquor Code.

23

"Licensee."  A licensed corporation that has obtained a keno

24

license from the bureau under this chapter.

25

"Secretary."  The Secretary of Revenue of the Commonwealth.

26

Section 403.  Keno games system.

27

A keno games system is established and shall be administered

28

by the bureau in accordance with this chapter.

29

Section 404.  Bureau of Pennsylvania State Lottery.

(a)  General powers.--

(1)  The bureau shall establish, administer and ensure

2

the integrity of keno games and shall have jurisdiction over

3

the location and operation of keno games.

4

(2)  The secretary shall employ an executive director,

5

deputies, secretaries, officers and representatives as

6

necessary, who shall serve at the secretary's pleasure. The

7

secretary shall employ other employees as the secretary sees

8

fit and whose duties and compensation shall be prescribed by

9

the secretary.

10

(b)  Specific powers.--The bureau shall have the following

11

powers and duties:

12

(1)  Investigate, evaluate and decide upon applications

13

for all keno licenses provided for in this chapter.

14

(2)  Issue keno licenses under section 406.

15

(3)  Promulgate regulations as the bureau deems necessary

16

to carry out the policy and purposes of this chapter and to

17

enhance the credibility and integrity of keno games in this

18

Commonwealth. Notwithstanding any other provision of law to

19

the contrary and in order to facilitate the prompt

20

implementation of this chapter, regulations promulgated by

21

the bureau during the first year of its existence shall not

22

be subject to notice of proposed rulemaking pursuant to

23

section 201 of the act of July 31, 1968 (P.L.769, No.240),

24

referred to as the Commonwealth Documents Law. Regulations

25

shall include:

26

(i)  Financial reporting and internal control

27

requirements for the operations of licensees that relate

28

to keno games.

29

(ii)  Manner in which gross revenue must be computed

30

and reported by the licensee.

(iii)  Procedures to be followed by licensees for

2

cash transactions affecting keno games.

3

(iv)  Criteria and conditions for the operation of

4

the keno games system.

5

(4)  Administer oaths, examine witnesses and issue

6

subpoenas to compel attendance of witnesses and production of

7

documents.

8

(5)  Provide for the assessment and collection of fines

9

and penalties for violations of this chapter. Fines and

10

penalties shall be credited for deposit to the fund.

11

(6)  Revoke or suspend a keno license provided for in

12

this chapter if the bureau finds by a preponderance of the

13

evidence that:

14

(i)  a licensee under this chapter, its officers,

15

employees or agents do not comply with the provisions of

16

this chapter or the regulations of the bureau; and

17

(ii)  it would be in the public interest, convenience

18

or necessity to revoke or suspend the keno license.

19

(7)  Restrict access to confidential information obtained

20

under this chapter and ensure that the confidentiality of

21

information is maintained and protected.

22

(8)  Require audits of the financial statements of the

23

operations of licensees that relate to keno games.

24

(9)  Require periodic financial reports from licensees

25

consistent with standards and intervals prescribed by the

26

bureau.

27

(10)  Enforce the prescribed hours for the conduct of

28

keno games, so that licensees may conduct keno games on any

29

day, except Christmas day, between the hours of 10 a.m. on

30

one day until 2 a.m. the next day.

(11)  Prohibit the offering of free alcohol or free malt

2

or free brewed beverages to patrons participating in keno

3

games.

4

(12)  Prohibit persons under 21 years of age from

5

participating in keno games.

6

Section 405.  Advisory committee.

7

(a)  Establishment.--There is established an advisory

8

committee within the department, to be known as the Keno Games

9

Advisory Committee. The advisory committee shall:

10

(1)  assist the bureau in developing and discussing

11

proposed regulation, final regulation and policy guidance;

12

and

13

(2)  provide continuing advice on implementing and

14

administering the provisions of this chapter.

15

(b)  Membership.--The advisory committee shall consist of the

16

following members:

17

(1)  The chairman of the Pennsylvania Liquor Control

18

Board or a designee.

19

(2)  The secretary or a designee.

20

(3)  One member appointed by the Governor with the advice

21

and consent of the Senate who must be representative of the

22

interests affected by this chapter.

23

(4)  Four legislative members: one appointed by the

24

Majority Leader of the Senate, one appointed by the Minority

25

Leader of the Senate, one appointed by the Majority Leader of

26

the House of Representatives and one appointed by the

27

Minority Leader of the House of Representatives, all of whom

28

must be representative of the interests affected by this

29

chapter.

(c)  Terms.--

(1)  Members under subsection (b)(1) and (2) shall serve

2

ex officio.

3

(2)  The initial members of the committee under

4

subsection (b)(3) and (4) shall be appointed within 60 days

5

of the effective date of this chapter. Of the initial

6

appointees:

7

(i)  the member appointed by the Governor shall serve

8

a one-year term;

9

(ii)  the members appointed by the Majority Leader of

10

the Senate and the Minority Leader of the Senate shall

11

serve two-year terms; and

12

(iii)  the members appointed by the Majority Leader

13

of the House of Representatives and the Minority Leader

14

of the House of Representatives shall serve three-year

15

terms.

16

(3)  Following expiration of the initial term under

17

paragraph (2), a member appointed under subsection (b)(3)

18

shall serve a three-year term.

19

(d)  Quorum.--Four members constitute a quorum.

20

(e)  Chairperson.--A chairperson shall be chosen by a

21

majority vote of the members present at a regularly scheduled

22

meeting. A person employed by the Commonwealth may not chair the

23

advisory committee.

24

(f)  Expenses.--Members of the advisory committee shall be

25

reimbursed for their travel expenses to attend advisory

26

committee meetings. Employees of the Commonwealth shall only be

27

entitled to the compensation and expenses they receive as public

28

employees.

29

(g)  Support.--The department shall provide the appropriate

30

administrative and technical support needed by the advisory

committee in order to accomplish its objectives.

Section 406.  Issuance of keno licenses.

3

(a)  Authorization.--The bureau may issue a keno license to a

4

licensed corporation that desires to conduct keno games in its

5

licensed premises if the licensed corporation makes application

6

to the bureau and abides by all of the provisions of this

7

chapter and regulations promulgated under this chapter. None of

8

the keno licenses provided for in this chapter shall be

9

transferable or assignable.

10

(b)  Restriction.--No applicant that has been convicted in

11

any jurisdiction of a felony, crime of moral turpitude or

12

gambling offense may be issued a keno license under this

13

chapter.

14

(c)  Suspension.--The bureau shall suspend the keno license

15

of a licensee which fails to satisfy the requirements of this

16

chapter during the term of the keno license until those

17

requirements are satisfied.

18

Section 407.  Application.

19

(a)  General rule.--A licensed corporation meeting the

20

requirements of section 406 which desires to conduct keno games

21

in its licensed premises must file an application form with the

22

bureau.

23

(b)  Form.--The bureau shall develop an application form

24

which collects information as deemed necessary by the bureau.

25

Section 408.  Accounting controls and audits.

26

(a)  Approval.--A licensed corporation which desires to

27

conduct keno games in its licensed premises must first obtain

28

approval of its internal control systems and audits from the

29

bureau.

30

(b)  Minimum requirements.--At a minimum, the following

internal controls and audits are required:

2

(1)  The safeguarding of its assets and revenues,

3

especially the recording of cash and evidences of

4

indebtedness related to the keno games.

5

(2)  The provision of reliable records; accounts; and

6

reports of transactions, operations and events. This

7

paragraph includes reports to the bureau which relate to the

8

keno games.

9

(3)  A procedure under which assets which relate to keno

10

games operations are safeguarded.

11

(4)  Accurate and reliable financial records which relate

12

to keno games operation.

13

(5)  Performance of transactions which relate to keno

14

games operations only in accordance with the management's

15

general or specific authorization.

16

(6)  Accurate recording of transactions which relate to

17

keno games operations to:

18

(i)  permit proper and timely reporting of gaming

19

revenue and of fees and taxes; and

20

(ii)  maintain accountability for assets.

21

(7)  Access to assets which relate to keno games

22

operations only in accordance with management's specific

23

authorization.

24

(8)  Recorded accountability for assets which relate to

25

keno games operations compared with actual assets at

26

reasonable intervals and appropriate action with respect to

27

any discrepancies.

28

(9)  Appropriate segregation and performance, in

29

accordance with sound practices by competent, qualified

30

personnel, of functions which relate to keno games

operations.

(c)  Internal control.--A licensed corporation which seeks to

3

conduct keno games in its licensed premises must describe, in

4

the manner the bureau may approve or require, its administrative

5

and accounting procedures which relate to keno games operations

6

in detail in a written system of internal control and must

7

submit a copy of its written keno games operations to the

8

bureau. Each written keno games operation must include:

9

(1)  An organizational chart depicting appropriate

10

segregation of functions.

11

(2)  A description of the responsibilities of each

12

position shown on the organizational chart.

13

(3)  A detailed narrative description of the

14

administrative and accounting procedures designed to satisfy

15

the requirements of subsection (b).

16

(4)  A written statement signed by the chief financial

17

officer of the licensed corporation and the chief executive

18

officer of the licensed corporation attesting that the

19

operation satisfies the requirements of this section.

20

(5)  Any other item that the bureau may require.

21

Section 409.  Keno games tax.

22

(a)  Imposition of tax.--Each licensed corporation shall pay

23

a tax in the amount of 60% of the net income arising from the

24

keno games after payment of prizes.

25

(b)  Payment and credit.--The tax imposed by this section

26

shall be paid by the licensed corporation through the department

27

for credit to the fund monthly on or before the 20th day of the

28

month next succeeding the month in which the tax accrues.

29

(c)  Administrative expenses.--No more than 10% of the tax

30

credited to the fund under subsection (b) may be used for the

administrative expenses of the system as incurred by the bureau.

2

(d)  Tax reconciliation.--If the amount of tax required to be

3

reported and paid under this section is later determined to be

4

greater or less than the amount actually reported and paid by

5

the licensed corporation, the bureau shall:

6

(1)  assess and collect the additional tax determined to

7

be due with interest on the tax until paid; or

8

(2)  provide for a refund of any overpayment, with

9

interest on the overpayment, to the licensed corporation.

10

(e)  Disposition of revenue.--Revenue generated from the tax,

11

minus administrative expenses under subsection (c), shall be

12

used as follows:

13

(1)  Except as set forth in this subsection, equal

14

amounts of the revenue shall be transferred into:

15

(i)  the Public School Employees' Retirement Fund;

16

and

17

(ii)  the State Employees' Retirement Fund.

18

(2)  When one of the funds specified in paragraph (1) is

19

declared actuarially sound, all of the revenue shall be

20

transferred into the other fund specified in paragraph (1).

21

(3)  When both of the funds specified in paragraph (1)

22

are declared actuarially sound, all of the revenue shall be

23

transferred into the Property Tax Relief Fund.

24

Section 410.  Declaration of exemption from Federal laws

25

prohibiting gambling devices.

26

This chapter constitutes the Commonwealth's exemption under

27

section 2 of the Gambling Devices Transportation Act (64 Stat.

28

1134, 15 U.S.C. § 1172).

29

Section 411.  Annual report.

30

The bureau shall, within 18 months of the effective date of

this chapter and each year thereafter, submit a report to the

2

Governor and the Secretary of the Senate and the Chief Clerk of

3

the House of Representatives on:

4

(1)  The general operation of the bureau under this

5

chapter.

6

(2)  Taxes.

7

(3)  Fees, fines and other revenues collected and

8

disbursed.

9

(4)  Number and result of hearings conducted under this

10

chapter.

11

(5)  Other information that the bureau deems necessary or

12

appropriate.

13

Section 2.  The sum of $1,500,000, or as much thereof as may

14

be necessary, is hereby appropriated to the Department of

15

Revenue for the establishment of the keno games system within

16

the Bureau of Pennsylvania State Lottery. The department shall

17

reimburse the General Fund from the revenue generated within the

18

first year of the conduct of keno games.

19

Section 3.  This act shall take effect in 60 days.
