| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in preliminary provisions, providing |
6 | for limitation on increases of salaries of school employees. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. The act of March 10, 1949 (P.L.30, No.14), known |
10 | as the Public School Code of 1949, is amended by adding a |
11 | section to read: |
12 | Section 118. Limitation on Increases of Salaries of School |
13 | Employes.--(a) During the course of a calendar year, any |
14 | increase in salary for a school employe shall be limited to a |
15 | percentage increase not in excess of the index. |
16 | (b) A school employe contract or collective bargaining |
17 | agreement entered into by a school entity shall: |
18 | (1) Limit the percentage of a salary increase from the prior |
19 | year to the current year and from one year to the next year |
20 | under the term of the contract to not more than the index or a |

1 | negotiated salary increase, whichever represents a lower |
2 | percentage increase. |
3 | (2) State that any future salary increase is subject to the |
4 | provisions of this section. |
5 | (c) This section shall apply to a school employe contract or |
6 | collective bargaining agreement entered into by a school entity |
7 | after the effective date of this section. |
8 | (d) For purposes of this section: |
9 | "Index" shall have the same meaning given to it under section |
10 | 302 of the act of June 27, 2006 (1st Sp. Sess., P.L.1873, No.1), |
11 | known as the Taxpayer Relief Act. |
12 | "School employe" shall include any professional employe, |
13 | substitute and temporary professional employe as defined in |
14 | section 1101 and all other persons employed by a school entity. |
15 | Section 2. This act shall take effect in 60 days. |
