| AN ACT |
| |
1 | Providing for the highway capital budget project itemization for |
2 | flood-damaged highways to be financed from debt incurred |
3 | under clause (1) of subsection (a) of section 7 of Article |
4 | VIII of the Constitution of Pennsylvania. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Short title. |
8 | This act shall be known and may be cited as the Capital |
9 | Budget Act of 2011 for Highways Damaged by Hurricane Irene and |
10 | Tropical Storm Lee. |
11 | Section 2. Authorization. |
12 | The total authorization for the capital projects in the |
13 | category of highway projects itemized in sections 4 through 31 |
14 | and to be constructed by the Department of Transportation, its |
15 | successors or assigns, and to be financed from debt incurred |
16 | under clause (1) of subsection (a) of section 7 of Article VIII |
17 | of the Constitution of Pennsylvania, shall be $75,000,000. |
18 | Section 3. Itemization of highway projects. |

1 | Additional capital projects in the category of public highway |
2 | projects to be constructed by the Department of Transportation, |
3 | its successors or assigns, and to be financed from debt incurred |
4 | under clause (1) of subsection (a) of section 7 of Article VIII |
5 | of the Constitution of Pennsylvania, are hereby itemized, |
6 | together with their respective estimated financial costs, in the |
7 | following sections. |

13 | Section 71. Estimated useful life of projects. |
14 | The General Assembly states the estimated useful life of the |
15 | projects heretofore itemized is 30 years. |
16 | Section 72. Federal funds. |
17 | All moneys received from the Federal Government for the |
18 | construction of the public highway projects specifically |
19 | itemized herein are also hereby appropriated for those projects. |
20 | Section 73. Construction. |
21 | Amounts contained in this act for any project shall not |
22 | supplant or replace any Federal funds authorized by any Federal |
23 | law or regulation. Funding from this act for any project is |
24 | available only to the extent that Federal funds are not |
25 | available for such project. |
26 | Section 74. Allocation of funds. |
27 | Whenever as determined by the Department of Transportation |
28 | that the full estimated financial costs of the projects itemized |
29 | in sections 4 through 31 are not necessary for the proper |
30 | design, acquisition or construction of such projects, the excess |

1 | funds no longer required may be allocated by the Department of |
2 | Transportation to increase the estimated costs of any one or |
3 | more of the projects specifically itemized in a capital budget. |
4 | Section 75. Effective date. |
5 | This act shall take effect immediately. |
