AN ACT

Requiring certain buses to operate by natural gas.

The General Assembly of the Commonwealth of Pennsylvania

3

hereby enacts as follows:

Section 1.  Short title.

5

This act shall be known and may be cited as the Pennsylvania

6

Public Transportation and Natural Gas Act.

Section 2.  Definitions.

The following words and phrases when used in this act shall

9

have the meanings given to them in this section unless the

10

context clearly indicates otherwise:

"Bus."  A motor vehicle designed for carrying 15 or more

12

passengers, exclusive of the driver, and used for the

13

transportation of persons, and a motor vehicle, other than a

14

taxicab, designed and used for the transportation of persons for

15

compensation.

"Fixed-route public transportation services."  Regularly

2

scheduled transportation that is available to the general public

3

and is provided according to published schedules along

4

designated published routes with specified stopping points for

5

the taking on and discharging of passengers, including public

6

buses. The term does not include commuter rail systems,

7

exclusive ride taxi services, charter or sightseeing services,

8

nonpublic transportation or school bus or limousine services.

"Natural gas."  Gas issued from the Earth's crust through

10

natural openings or bored wells and that is typically a

11

combustible mixture of methane and other hydrocarbons used

12

chiefly as a fuel and raw material. The term includes both

13

compressed and liquefied forms of natural gas.

Section 3.  New bus requirements.

15

An operator of fixed-route public transportation services in

16

this Commonwealth shall, when removing an older bus from such

17

service, replace the older bus with a model using natural gas as

18

its fuel source.

Section 4.  Effective date.

20

This act shall take effect in 60 days or January 1, 2011,

21

whichever is later.
