AN ACT

Amending Title 74 (Transportation) of the Pennsylvania

2

Consolidated Statutes, providing for design, construction and

3

renovation of certain State transportation infrastructure

4

using a design-build approach; and establishing the Design-

5

Build Advisory Committee.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Title 74 of the Pennsylvania Consolidated

9

Statutes is amended by adding a part to read:

§ 9101.  Definitions.

The following words and phrases when used in this chapter

6

shall have the meanings given to them in this section unless the

7

context clearly indicates otherwise:

8

"Committee."  The Design-Build Advisory Committee established

9

under section 9103 (relating to Design-Build Advisory

10

Committee).

11

"Department."  The Department of Transportation of the

12

Commonwealth.

13

§ 9102.  Design-build policy.

14

(a)  Authorization.--A design-build delivery system may be

15

authorized when the department makes a determination in writing

16

that it is in the best interest of the public to enter into a

17

design-build contract.

18

(b)  Standard.--A determination under subsection (a) shall be

19

issued only after the department has demonstrated that the

20

design-build approach meets its needs better than the

21

traditional design-bid-build approach established under 62

22

Pa.C.S. § 905 (relating to procurement of design professional

23

services) for the project under consideration.

24

§ 9103. Design-Build Advisory Committee.

25

(a)  Establishment.--There is established under the

26

jurisdiction of the department the Design-Build Advisory

27

Committee.

28

(b)  Composition.--The committee shall consist of the

29

following members:

30

(1)  The Secretary of Transportation, ex officio.

(2)  The Secretary of General Services, ex officio.

(3)  The chairman and minority chairman of the

3

Transportation Committee of the Senate.

4

(4)  The chairman and minority chairman of the

5

Transportation Committee of the House of Representatives.

6

(5)  Members of the public who have extensive experience

7

and knowledge of design-build issues throughout this

8

Commonwealth, to be appointed by the Governor as follows:

9

(i)  Two members representing the American Council of

10

Engineering Companies of Pennsylvania.

11

(ii)  Two members representing the Associated

12

Pennsylvania Constructors.

13

(iii)  One member representing the Design-Build

14

Institute of America, Pennsylvania Chapter.

15

(iv)  One member representing the American Institute

16

of Architects of Pennsylvania.

17

(6)  Each member set forth in paragraphs (1), (2), (3)

18

and (4) may designate an alternate to serve in the member's

19

stead, which member shall notify the chairman in writing of

20

the designation.

21

(c)  Terms of appointees.--The terms of members of the

22

committee appointed by the Governor shall be three years. A

23

member of the committee may be reappointed for additional terms.

24

An individual appointed to fill a vacancy shall serve for the

25

unexpired term and shall be eligible for reappointment.

26

(d)  Officers.--The members of the committee shall annually

27

elect a chairman, a vice chairman and a secretary from among the

28

public members of the committee.

(e)  Meetings and expenses.--

(1)  The committee shall meet at least annually.

(2)  A public member who misses three consecutive

2

meetings without good cause acceptable to the chairman may be

3

replaced by the Governor.

4

(3)  The public members of the committee shall be allowed

5

actual, necessary and reasonable per diem expenses in

6

accordance with regulations of the executive board. The

7

department shall provide appropriate staff support to enable

8

the committee to properly carry out its functions.

§ 9104.  Regulations.

10

(a)  Regulations.--To ensure fair, uniform, clear and

11

effective procedures for the delivery of a quality project on

12

time and within budget, the department, in consultation with the

13

committee, shall promulgate regulations for use by the

14

department when procuring a design-build project delivery

15

system.

16

(b)  Interim regulations.--Within 120 days following the

17

effective date of this subsection, the department shall publish

18

draft interim regulations implementing the provisions of this

19

chapter in the Pennsylvania Bulletin for comment. The draft

20

interim regulations shall have a 60-day public comment period.

21

Within 90 days following the close of the public comment period

22

on the draft interim regulations, the department shall publish

23

final interim regulations in the Pennsylvania Bulletin

24

implementing this chapter. The draft interim regulations and the

25

final interim regulations shall not be subject to section 201 of

26

the act of July 31, 1968 (P.L.769, No.240), referred to as the

27

Commonwealth Documents Law, nor to review or approval under the

28

act of June 25, 1982 (P.L.633, No.181), known as the Regulatory

29

Review Act. The final interim regulations shall expire on the

30

earlier of the following:

(1)  Two years after publication in the Pennsylvania

2

Bulletin.

3

(2)  The publication of final regulations pursuant to the

4

Commonwealth Documents Law and the Regulatory Review Act.

§ 9105.  Contract awards.

6

For each proposed design-build project, a two-phase procedure

7

for awarding design-build contracts shall be adopted and shall

8

include the following:

9

(1)  During phase one, and prior to solicitation, the

10

department shall develop, with the assistance of a design

11

professional, a scope of work statement that defines the

12

project and provides prospective bidders with sufficient

13

information regarding the department's requirements. The

14

scope of work statement shall include criteria and

15

preliminary design, general budget parameters and general

16

schedule or delivery requirements to enable the design-

17

builders to submit proposals which meet the department's

18

needs.

19

(2)  Once the department has developed and published a

20

scope of work statement, it shall evaluate and shortlist a

21

maximum of five design-builders based on their

22

qualifications.

23

(3)  During phase two, the shortlisted firms shall be

24

invited to submit detailed specific technical concepts or

25

solutions, costs and scheduling information. Unsuccessful

26

firms may be paid a stipend to cover proposal expenses. After

27

evaluation of these submissions, a selection shall be made

28

and the contract awarded to the highest ranked firm.

29

§ 9106.  Committee advice and comment.

30

The committee shall advise and comment on all phases of

design-build activities being undertaken or financially assisted

2

by the department.

3

Section 2.  This act shall take effect as follows:

4

(1)  The following provisions shall take effect

5

immediately:

6

(i)  74 Pa.C.S. §§ 9103 and 9104.

7

(ii)  This section.

8

(2)  The remainder of this act shall take effect on the

9

earlier of 60 days or the date of publication of draft

10

interim regulations under 74 Pa.C.S. § 9104(b).
