AN ACT

  

1

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in preliminary provisions, further

6

providing for background checks of prospective employees and

7

conviction of employees of certain offenses.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

10

Section 1.  Section 111 heading of the act of March 10, 1949

11

(P.L.30, No.14), known as the Public School Code of 1949,  

12

amended December 19, 1990 (P.L.1362, No.211), is amended and the

13

section is amended by adding a subsection to read:

14

Section 111.  Background Checks of Prospective Employes and

15

Volunteers; Conviction of Employes of Certain Offenses.--* * *

16

(c.3)  (1)  If a public or private school, intermediate unit

17

or area vocational-technical school requires a volunteer to

18

submit a report of criminal history record information that

19

satisfies subsection (b) or a set of fingerprints for Federal

20

criminal history record information that satisfies subsection

(c), then the public or private school, intermediate unit or

2

area vocational-technical school shall reimburse the volunteer

3

for the cost of obtaining the information.

4

(2)  The Department of Education shall, to the extent funds

5

are appropriated or otherwise made available to the department

6

for such purpose, pay each public or private school,

7

intermediate unit or area vocational-technical school for the

8

costs incurred in obtaining the information specified in

9

paragraph (1) from volunteers.

10

(3)  For purposes of this subsection, a "volunteer" is a

11

person who provides services to a public or private school,

12

intermediate unit or area vocational-technical school without

13

compensation or other remuneration from the public or private

14

school, intermediate unit or area vocational-technical school

15

for the services.

Section 2.  This act shall take effect in 60 days.
