AN ACT

Providing for the regulation of outdoor wood-fired boilers;

2

requiring certain notices to buyers and lessees of outdoor

3

wood-fired boilers; and providing for enforcement by the

4

Department of Environmental Protection.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Short title.

8

This act shall be known and may be cited as the Pennsylvania

9

Outdoor Wood-Fired Boiler Act.

10

Section 2.  Definitions.

11

The following words and phrases when used in this act shall

12

have the meanings given to them in this section unless the

13

context clearly indicates otherwise:

14

"BTU" or "British thermal unit."  The amount of thermal

15

energy necessary to raise the temperature of one pound of pure

16

liquid water 1° F at the temperature at which water has its

17

greatest density (39° F).

18

"Clean wood."  The term includes the following:

19

(1)  Wood that contains no paint, stains or other types

of coatings.

(2)  Wood that has not been treated with preservatives,

3

including, but not limited to, copper, chromium arsenate,

4

creosote or pentachlorophenol.

5

"Department."  The Department of Environmental Protection of

6

the Commonwealth.

7

"EPA."  United States Environmental Protection Agency.

8

"Outdoor wood-fired boiler."  An outdoor wood-fired furnace,

9

outdoor wood-burning appliance, outdoor hydronic heater, outdoor

10

water stove or other fuel-burning device that is designed to

11

burn, or is capable of burning, clean wood or other fuels in

12

outdoor installations or in structures not normally intended for

13

habitation by humans or domestic animals, including structures

14

like garages and sheds, for the purpose of space or water

15

heating, or both.

16

"Person."  An individual, public or private corporation for

17

profit or not-for-profit, association, partnership, firm, trust,

18

estate, department, board, bureau or agency of the Federal

19

Government or State government, political subdivision,

20

municipality, district, authority or any other legal entity

21

recognized by law as the subject of rights and duties.

22

"Phase 2 outdoor wood-fired boiler."  An outdoor wood-fired

23

boiler that has been certified or qualified by the United States

24

Environmental Protection Agency as meeting a particulate matter

25

emission limit of 0.32 pounds per million BTUs output and is

26

labeled accordingly.

27

"Stack."  A vertical structure that encloses a flue that

28

carries off smoke or exhaust from a furnace. The term includes,

29

but is not limited to, the part of a structure that extends

30

above the roof.

Section 3.  Prohibition.

(a)  General rule.--No person shall manufacture, supply,

3

distribute, lease, install, use, operate or maintain an outdoor

4

wood-fired boiler that does not comply with the Phase 2 outdoor

5

wood-fired boiler particulate matter standards in this

6

Commonwealth unless it is intended for shipment and use outside

7

this Commonwealth.

8

(b)  Inapplicability.--This act shall not apply to:

9

(1)  grilling or cooking using charcoal, wood, propane or

10

natural gas in cooking or grilling appliances, stoves,

11

furnaces, fireplaces or other heating devices within a

12

building used for human or animal habitation; or

13

(2)  the use of propane, acetylene, natural gas, gasoline

14

or kerosene in a device intended for heating, construction or

15

maintenance activities.

16

Section 4.  Setback requirements for Phase 2 outdoor wood-fired

17

boilers.

18

A person may not install a Phase 2 outdoor wood-fired boiler

19

in this Commonwealth unless the boiler is installed a minimum of

20

150 feet from the nearest property line.

21

Section 5.  Stack height requirements.

22

(a)  Stack height requirements for Phase 2 outdoor wood-fired

23

boilers.--No person may install, use or operate a Phase 2

24

outdoor wood-fired boiler in this Commonwealth unless:

25

(1)  The boiler has a permanently attached stack.

26

(2)  The stack extends at least ten feet above the ground

27

and extends at least two feet above the highest peak of the

28

highest residence located within 150 feet of the outdoor

29

wood-fired boiler.

(b)  Stack height requirements for existing outdoor wood-

fired boilers.--No person may use or operate an outdoor wood-

2

fired boiler that was installed before the effective date of

3

this section unless:

4

(1)  The boiler has a permanently attached stack.

5

(2)  The stack extends at least ten feet above the ground

6

and extends at least two feet above the highest peak of the

7

highest residence located within 500 feet of the outdoor

8

wood-fired boiler.

9

If the existing outdoor wood-fired boiler is a Phase 2 outdoor

10

wood-fired boiler, the requirements of subsection (a) shall

11

apply.

12

Section 6.  Types of fuels.

13

(a)  Permitted fuels.--A person that owns, leases, uses or

14

operates a new or existing outdoor wood-fired boiler in this

15

Commonwealth may use only the following fuels:

16

(1)  Clean wood.

17

(2)  Wood pellets made from clean wood.

18

(3)  Home heating oil, natural gas or propane that

19

complies with all applicable sulfur limits and is used as a

20

starter or supplemental fuel for dual-fired outdoor wood-

21

fired boilers.

22

(4)  Other fuels approved by the department in accordance

23

with this act.

24

(b)  Prohibited fuels.--No person who owns, leases, uses or

25

operates an outdoor wood-fired boiler in this Commonwealth may

26

burn treated or painted wood, furniture, garbage, tires, lawn

27

clippings or yard waste, material containing plastic or rubber,

28

waste petroleum products, paints and paint thinners, chemicals,

29

hazardous waste, coal, glossy colored paper, construction and

30

demolition debris, plywood, particleboard, salt water driftwood,

manure, animal carcasses, asphalt products or any fuel or

2

material in an outdoor wood-fired boiler other than those fuels

3

listed in subsection (a).

(c)  Regulatory requirements.--No person may use or operate

5

an outdoor wood-fired boiler in this Commonwealth unless it

6

complies with all applicable regulations and statutes of this

7

Commonwealth.

8

Section 7.  Prohibition of operation for new and existing

9

outdoor wood-fired boilers.

10

No person may use or operate a new or existing outdoor wood-

11

fired boiler between May 1 and September 30.

12

Section 8.  Written notice.

13

(a)  General rule.--Prior to the execution of a sale or lease

14

for a new or used outdoor wood-fired boiler, the distributor,

15

seller or lessor shall provide the prospective buyer or lessee

16

with a copy of this section and a written notice that includes

17

the following:

18

(1)  An acknowledgment that the buyer was provided with a

19

copy of this section.

20

(2)  A written list of the fuels allowed under section

21

6(a).

22

(3)  A written statement that a person who owns, leases,

23

uses or operates an outdoor wood-fired boiler in this

24

Commonwealth may not burn a fuel or material in the outdoor

25

wood-fired boiler other than those fuels listed under section

26

6(a).

27

(4)  A written statement that even if the requirements

28

specified in this section are met, the installation and

29

operation of the outdoor wood-fired boiler may be subject to:

30

(i)  Other applicable Commonwealth regulations and

statutes including the regulations and statutes listed

2

under section 6(c).

(ii)  Local regulations or local stack height or

4

setback requirements that will further limit or prohibit

5

the use of the purchased or leased outdoor wood-fired

6

boiler.

(5)  A written statement that the stack height and

8

setback requirements of this act may not be adequate in some

9

areas of this Commonwealth due to terrain that could render

10

the operation of the outdoor wood-fired boiler a nuisance or

11

public health hazard.

12

(6)  The name, address and telephone number of the

13

distributor, seller or lessor.

14

(7)  The make, model name or number and date of

15

manufacture of the outdoor wood-fired boiler.

16

(8)  The name, address and telephone number of the buyer

17

or lessee.

18

(9)  The location where the outdoor wood-fired boiler

19

will be installed.

20

(b)  Execution of notice.--The written notices required in

21

subsection (a) must be signed and dated by the buyer or lessee

22

and the distributor, seller or lessor when the sale or lease of

23

the outdoor wood-fired boiler is completed.

24

(c)  Recordkeeping requirements.--The distributor, seller or

25

lessor shall keep records of written notices required under this

26

section onsite for five years and provide the records to the

27

department upon request.

28

Section 9.  Enforcement.

29

The department shall enforce the provisions of this act.

Section 10.  Regulations.

The Environmental Quality Board shall formulate, adopt and

2

promulgate rules and regulations necessary to implement and

3

administer this act.

4

Section 11.  Effective date.

5

This act shall take effect in 60 days.
