| AN ACT |
| |
1 | Amending the act of April 9, 1929 (P.L.177, No.175), entitled |
2 | "An act providing for and reorganizing the conduct of the |
3 | Executive Department thereof and the administrative |
4 | departments, boards, commissions, and officers thereof, |
5 | including the boards of trustees of State Normal Schools, or |
6 | Teachers Colleges; abolishing, creating, reorganizing or |
7 | authorizing the reorganization of certain administrative |
8 | departments, boards, and commissions; defining the powers and |
9 | duties of the Governor and other executive and administrative |
10 | officers, and of the several administrative departments, |
11 | boards, commissions, and officers; fixing the salaries of the |
12 | Governor, Lieutenant Governor, and certain other executive |
13 | and administrative officers; providing for the appointment of |
14 | certain administrative officers, and of all deputies and |
15 | other assistants and employes in certain departments, boards, |
16 | and commissions; and prescribing the manner in which the |
17 | number and compensation of the deputies and all other |
18 | assistants and employes of certain departments, boards and |
19 | commissions shall be determined," in Department of Aging, |
20 | further providing for the allocation of Federal and State |
21 | funds to area agencies. |
22 | The General Assembly of the Commonwealth of Pennsylvania |
23 | hereby enacts as follows: |
24 | Section 1. Section 2210-A of the act of April 9, 1929 (P.L. |
25 | 177, No.175), known as The Administrative Code of 1929, amended |

1 | December 15, 1988 (P.L.1244, No.153), is amended to read: |
2 | Section 2210-A. Allocation of Resources.--(a) The area |
3 | agency shall receive a basic allocation of resources, consisting |
4 | of State and Federal funds weighted by the proportion of older |
5 | poor persons who reside in the planning and service area in |
6 | relation to the total number of older poor persons who reside in |
7 | the Commonwealth of Pennsylvania utilizing poverty threshold |
8 | income standards as determined by the United States Office of |
9 | Management and Budget [except that each area agency shall be |
10 | held harmless to the amount of State funds received in the |
11 | preceding program year]. |
12 | (b) The department may allocate additional resources to area |
13 | agencies based upon the total number of older persons who reside |
14 | within the planning and service area, the availability of |
15 | transportation services, the rural-urban distribution of older |
16 | persons, and attendant rural program cost differentials, the |
17 | need for social and medical services, the amount of funds |
18 | devoted by county commissioners for older persons and other |
19 | special circumstances as determined by the secretary. |
20 | (c) Funds appropriated to carry out the purposes of this act |
21 | shall be distributed to the local authorities or nonprofit |
22 | agencies as grants or cost reimbursement for services to the |
23 | aging, if there is an acceptable plan in accordance with section |
24 | 2209-A. |
25 | Section 2. This act shall take effect immediately. |
