AN ACT

Amending Title 71 (State Government) of the Pennsylvania

2

Consolidated Statutes, in State Employees Retirement System,

3

further providing for mandatory and optional membership.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 5301(c) of Title 71 of the Pennsylvania

7

Consolidated Statutes is amended and the section is amended by

8

adding a subsection to read:

9

§ 5301.  Mandatory and optional membership.

10

(c)  Prohibited membership.--[The] Except as provided in

12

subsection (g), the State employees listed in subsection (a)

13

(12), (13), (14) and (15) shall not have the right to elect

14

membership in the system.

(g)  Transfer of membership.--All State employees referred to

17

in subsection (a)(12) shall have the right to terminate

membership in an independent retirement program and elect

2

membership in Class AA of the system within 180 days of the

3

effective date of this subsection. State employees referred to

4

in subsection (a)(12), either who are employed in a tenure track

5

position but who have not received tenure on the effective date

6

of this subsection or who become employed in a tenure track

7

position after the effective date of this subsection, shall have

8

the right to terminate membership in an independent retirement

9

program and elect membership in Class AA of the system within

10

180 days of receiving tenure. Once such election is exercised,

11

membership shall become effective on the earlier of the first

12

day of July or first day of February next following the filing

13

of the election with the board and shall continue until the

14

termination of State service.

Section 2.  This act shall take effect January 1, 2010.
