A RESOLUTION

Honoring the 80th anniversary of the passage and signing of the

2

Davis-Bacon Act.

3

WHEREAS, The Davis-Bacon Act, cosponsored by Senator James J.

4

Davis of Pennsylvania and Representative Robert L. Bacon of New

5

York, was signed by President Herbert Hoover on March 3, 1931;

6

and

7

WHEREAS, The Davis-Bacon Act established the requirement that

8

workers on Federally funded construction, repair or alteration

9

projects in excess of $2,000 be paid at or above a prevailing

10

wage level determined by the United States Department of Labor;

11

and

12

WHEREAS, The Congress of the United States has added

13

provisions of the Davis-Bacon Act requiring a fair wage on

14

Federally funded projects to approximately 60 Federal statutes

15

so that workers earn the prevailing wage for construction

projects receiving Federal grants, loans, loan guarantees and

2

insurance; and

3

WHEREAS, Many states, including Pennsylvania, have adopted

4

their own prevailing wage statutes to ensure that public dollars

5

are used to pay a fair wage to construction workers on public

6

projects; and

7

WHEREAS, While the origins of the Davis-Bacon Act are often

8

criticized as having been rooted in discrimination and racism,

9

the act has evolved and emerged as an essential guarantee to

10

fair wages for all workers and is supported as such by persons

11

of all races, creeds and political affiliations; and

12

WHEREAS, The Federal prevailing wage for a specific

13

geographic area is calculated by the Department of Labor based

14

on the wage data voluntarily submitted by contractors and labor

15

unions in that area; and

16

WHEREAS, The Pennsylvania prevailing wage for a specific

17

geographic area is calculated by the Department of Labor and

18

Industry and allows contractors and labor unions alike to submit

19

wage data to be included in the prevailing wage determinations

20

by the Department of Labor and Industry; and

21

WHEREAS, The rate floor that results from the prevailing wage

22

encourages competition based on merit, skill and a high standard

23

of craftsmanship rather than one characterized by underbidding

24

and substandard work; therefore be it

25

RESOLVED, That the House of Representatives honor the 80th

26

anniversary of the passage and signing of the Davis-Bacon Act.
