AN ACT

Amending the act of April 9, 1929 (P.L.343, No.176), entitled,

2

as amended, "An act relating to the finances of the State

3

government; providing for the settlement, assessment,

4

collection, and lien of taxes, bonus, and all other accounts

5

due the Commonwealth, the collection and recovery of fees and

6

other money or property due or belonging to the Commonwealth,

7

or any agency thereof, including escheated property and the

8

proceeds of its sale, the custody and disbursement or other

9

disposition of funds and securities belonging to or in the

10

possession of the Commonwealth, and the settlement of claims

11

against the Commonwealth, the resettlement of accounts and

12

appeals to the courts, refunds of moneys erroneously paid to

13

the Commonwealth, auditing the accounts of the Commonwealth

14

and all agencies thereof, of all public officers collecting

15

moneys payable to the Commonwealth, or any agency thereof,

16

and all receipts of appropriations from the Commonwealth,

17

authorizing the Commonwealth to issue tax anticipation notes

18

to defray current expenses, implementing the provisions of

19

section 7(a) of Article VIII of the Constitution of

20

Pennsylvania authorizing and restricting the incurring of

21

certain debt and imposing penalties; affecting every

22

department, board, commission, and officer of the State

23

government, every political subdivision of the State, and

24

certain officers of such subdivisions, every person,

25

association, and corporation required to pay, assess, or

26

collect taxes, or to make returns or reports under the laws

27

imposing taxes for State purposes, or to pay license fees or

28

other moneys to the Commonwealth, or any agency thereof,

29

every State depository and every debtor or creditor of the

30

Commonwealth," in special funds, providing for the Pension

31

Obligation Reserve Fund.

hereby enacts as follows:

Section 1.  Article XVII-A of the act of April 9, 1929

3

(P.L.343, No.176), known as The Fiscal Code, is amended by

4

adding a subarticle to read:

5

SUBARTICLE K

6

PENSION OBLIGATION RESERVE FUND

7

Section 1795.1-A.  Establishment of Pension Obligation Reserve

8

Fund.

9

The Pension Obligation Reserve Fund is established as a

10

separate fund in the State Treasury.

11

Section 1795.2-A.  Funding.

12

(a)  Intent.--It is hereby declared as the intent and goal of

13

the General Assembly to create a reserve fund to provide for

14

future payments toward the Commonwealth's unfunded pension

15

liabilities.

16

(b)  Transfer of portion of surplus.--For fiscal years

17

beginning after June 30, 2010, if the Secretary of the Budget

18

certifies that there is a surplus in the General Fund for a

19

specific fiscal year, the following shall apply:

20

(1)  The Secretary of the Budget shall calculate a

21

transfer to the Pension Obligation Reserve Fund by

22

subtracting the transfer to the Budget Stabilization Reserve

23

Fund under section 1702-A from 50% of the surplus for the

24

fiscal year.

25

(2)  The amount of the transfer determined under

26

paragraph (1) shall be deposited into the Pension Obligation

27

Reserve Fund by the end of the next succeeding quarter.

28

(c)  Appropriated funds.--The General Assembly may at any

29

time provide additional amounts from any funds available to the

30

Commonwealth as an appropriation to the Pension Obligation

Section 1795.3-A.  Disposition of Pension Obligation Reserve

3

Fund.

(a)  General rule.--Subject to the provisions of subsection

5

(b), the General Assembly may appropriate money from the Pension

6

Obligation Reserve Fund to provide for the Commonwealth's

7

obligations under 24 Pa.C.S. § 8326 (relating to contributions

8

by the Commonwealth) or 8327 (relating to payments by employers)

9

or 71 Pa.C.S. § 5507 (relating to contributions by the

10

Commonwealth and other employers). Any money appropriated under

11

this section which lapses shall be returned to the Pension

12

Obligation Reserve Fund.

(b)  Timing of appropriation.--An amount that is deposited in

14

the Pension Obligation Reserve Fund under section 1795.2-A may

15

be appropriated not sooner than the beginning of the second

16

fiscal year following the fiscal year for which the deposit was

17

calculated.

Section 2.  The addition of Subarticle K of Article XVII-A of

19

the act shall apply to fiscal years beginning after June 30,

20

2010.

Section 3.  This act shall take effect immediately.
