AN ACT

  

1

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

Consolidated Statutes, providing for the offense of

3

aggravated assault by a person in custody.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Title 18 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 2703.2.  Aggravated assault by a person in custody.

9

A person who is in the custody of the police or other law

10

enforcement agency commits a felony of the third degree if he,

11

while in custody, intentionally or knowingly causes or attempts

12

to cause another to come into contact with blood, seminal fluid,

13

saliva, urine or feces by throwing, tossing, spitting or

14

expelling such fluid or material.

15

Section 2.  This act shall take effect in 60 days.
