AN ACT

Amending Title 74 (Transportation) of the Pennsylvania

2

Consolidated Statutes, providing for annual limitation on

3

expenditure from Motor License Fund; and establishing the

4

Pennsylvania State Police Fund and the Local Highway and

5

Bridge Fund.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Title 74 of the Pennsylvania Consolidated

9

Statutes is amended by adding sections to read:

10

§ 304.  Annual limitation on expenditure from Motor License

11

Fund.

12

Not more than the following amounts for the fiscal years

13

specified may be expended or transferred from the Motor License

14

Fund for the purpose of the operations of the Pennsylvania State

15

Police:

16

(1)  For the fiscal year beginning July 1, 2011, not more

17

than $500,000,000.

18

(2)  For the fiscal year beginning July 1, 2012, not more

19

than $450,000,000.

(3)  For the fiscal year beginning July 1, 2013, not more

2

than $400,000,000.

(4)  For the fiscal year beginning July 1, 2014, not more

4

than $350,000,000.

(5)  For the fiscal year beginning July 1, 2015, not more

6

than $300,000,000.

(6)  For the fiscal year beginning July 1, 2016, not more

8

than $250,000,000.

(7)  For the fiscal year beginning July 1, 2017, not more

10

than $200,000,000.

(8)  For the fiscal year beginning July 1, 2018, not more

12

than $150,000,000.

(9)  For the fiscal year beginning July 1, 2019, not more

14

than $100,000,000.

(10)  For the fiscal year beginning July 1, 2020, not

16

more than $50,000,000.

(11)  For the fiscal year beginning July 1, 2021, and

18

each fiscal year thereafter, no moneys may be expended or

19

transferred from the Motor License Fund for that purpose.

§ 305.  Pennsylvania State Police Fund.

21

(a)  Establishment.--The Pennsylvania State Police Fund is

22

established in the State Treasury. The moneys of the fund are

23

appropriated to the Pennsylvania State Police on a continuing

24

basis for the purposes set forth in this section.

25

(b)  Source of funding.--Notwithstanding any other provision

26

of law to the contrary, the following amounts for the fiscal

27

years specified shall be deposited into the fund from moneys

28

collected under Article II of the act of March 4, 1971 (P.L.6,

29

No.2), known as the Tax Reform Code of 1971:

(1)  For the fiscal year beginning July 1, 2012,

(2)  For the fiscal year beginning July 1, 2013,

(3)  For the fiscal year beginning July 1, 2014,

(4)  For the fiscal year beginning July 1, 2015,

(5)  For the fiscal year beginning July 1, 2016,

(6)  For the fiscal year beginning July 1, 2017,

(c)  Use of funds.--In addition to any other moneys

21

appropriated or made available to the Pennsylvania State Police

22

for any purpose, the moneys of the fund shall be expended by the

23

Pennsylvania State Police for the purpose of its operations,

24

including, but not limited to, the enforcement of the provisions

25

of 75 Pa.C.S. (relating to vehicles) and other laws on the

26

highways of this Commonwealth.

(d)  Definition.--For purposes of this section, "fund" means

28

the Pennsylvania State Police Fund established under this

29

section.

§ 306.  Local Highway and Bridge Fund.

(a)  Establishment.--The Local Highway and Bridge Fund is

established in the State Treasury. The moneys of the fund are

3

appropriated to the department on a continuing basis for the

4

purposes set forth in this section.

(b)  Source of funding.--Notwithstanding any other provision

6

of law to the contrary, the following amounts for the fiscal

7

years specified shall be transferred into the fund from moneys

8

in the Motor License Fund:

9

(1)  For the fiscal year beginning July 1, 2011,

10

$25,000,000.

11

(2)  For the fiscal year beginning July 1, 2012,

12

$50,000,000.

13

(3)  For the fiscal year beginning July 1, 2013,

14

$75,000,000.

15

(4)  For the fiscal year beginning July 1, 2014,

16

$100,000,000.

17

(5)  For the fiscal year beginning July 1, 2015,

18

$125,000,000.

19

(6)  For the fiscal year beginning July 1, 2016,

20

$150,000,000.

(7)  For the fiscal year beginning July 1, 2017,

22

$175,000,000.

(8)  For the fiscal year beginning July 1, 2018,

$200,000,000.

(9)  For the fiscal year beginning July 1, 2019,

$225,000,000.

(10)  For the fiscal year beginning July 1, 2020,

$250,000,000.

(c)  Use of funds.--The department shall use these funds to

provide grants to municipalities for road and bridge funding
