AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

Statutes, further providing for disqualification for

3

commercial driver's license.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1611(a)(5) of Title 75 of the

7

Pennsylvania Consolidated Statutes is amended to read:

8

§ 1611.  Disqualification.

9

(a)  First violation of certain offenses.--Upon receipt of a

10

report of conviction, the department shall, in addition to any

11

other penalties imposed under this title, disqualify any person

12

from driving a commercial motor vehicle or school vehicle for a

13

period of one year for the first violation of:

(5)  any felony or any misdemeanor under 18 Pa.C.S. Ch.

16

39 (relating to theft and related offenses) in the commission

17

of which a court determines a motor vehicle was essentially

18

involved and where the person was a commercial driver at the

time the violation occurred, except as described in

subsection (e);

Section 2.  This act shall take effect in 60 days.
