AN ACT

Providing for law enforcement officer residency requirements.

The General Assembly of the Commonwealth of Pennsylvania

3

hereby enacts as follows:

Section 1.  Short title.

5

This act shall be known and may be cited as the Law

6

Enforcement Officer Residency Act.

7

Section 2.  Definitions.

8

The following words and phrases when used in this act shall

9

have the meanings given to them in this section unless the

10

context clearly indicates otherwise:

11

"Law enforcement officer."  A person employed by a

12

municipality to provide law enforcement services on behalf of

13

the municipality. The term includes a person employed to provide

14

law enforcement services for a regional police force in this

15

Commonwealth.

"Municipality."  A city, borough, township or municipal

17

authority in this Commonwealth.

Section 3.  Residency requirements.

(a)  Municipal residency.--Notwithstanding any other

3

provision of law to the contrary, no municipality may require

4

its law enforcement officers to be residents of the municipality

5

in order to serve in the capacity of a law enforcement officer.

(b)  Commonwealth residency.--A municipality may require its

7

law enforcement officers to be residents of this Commonwealth.

8

(c)  United States citizenship.--This act shall not be

9

construed to affect any law that requires law enforcement

10

officers of a municipality to be citizens of the United States

11

or that imposes eligibility requirements other than residency

12

for law enforcement officers.

Section 4.  Construction.

14

This act shall not be construed to conflict with any existing

15

collective bargaining agreement.

16

Section 5.  Applicability.

17

This act shall apply to any collective bargaining agreement

18

executed after the effective date of this section.

Section 6.  Effective date.

20

This act shall take effect in 60 days.
