| AN ACT |
| |
1 | Amending the act of April 9, 1929 (P.L.177, No.175), entitled |
2 | "An act providing for and reorganizing the conduct of the |
3 | executive and administrative work of the Commonwealth by the |
4 | Executive Department thereof and the administrative |
5 | departments, boards, commissions, and officers thereof, |
6 | including the boards of trustees of State Normal Schools, or |
7 | Teachers Colleges; abolishing, creating, reorganizing or |
8 | authorizing the reorganization of certain administrative |
9 | departments, boards, and commissions; defining the powers and |
10 | duties of the Governor and other executive and administrative |
11 | officers, and of the several administrative departments, |
12 | boards, commissions, and officers; fixing the salaries of the |
13 | Governor, Lieutenant Governor, and certain other executive |
14 | and administrative officers; providing for the appointment of |
15 | certain administrative officers, and of all deputies and |
16 | other assistants and employes in certain departments, boards, |
17 | and commissions; and prescribing the manner in which the |
18 | number and compensation of the deputies and all other |
19 | assistants and employes of certain departments, boards and |
20 | commissions shall be determined," providing for the powers |
21 | and duties of the Department of Labor and Industry in job |
22 | creation; and making related repeals. |
23 | The General Assembly of the Commonwealth of Pennsylvania |
24 | hereby enacts as follows: |
25 | Section 1. The act of April 9, 1929 (P.L.177, No.175), known |
26 | as The Administrative Code of 1929, is amended by adding a |
27 | section to read: |

1 | Section 2210.2. Job Creation.--The Department of Labor and |
2 | Industry shall have the power and its duties shall be: |
3 | (a) To administer, in consultation with the Department of |
4 | Community and Economic Development, job training programs |
5 | authorized under Chapter 29 of the act of June 29, 1996 |
6 | (P.L.434, No.67), known as the "Job Enhancement Act." |
7 | (b) To administer, in consultation with the Department of |
8 | Education: |
9 | (1) Job training programs authorized under the Wagner-Peyser |
10 | Act (June 6, 1933, c.49, 29 U.S.C. § 49 et seq.). |
11 | (2) Job training and skill enhancement programs under the |
12 | act of October 22, 1986 (P.L.1452, No.143), known as the |
13 | "Pennsylvania Adult and Family Literacy Education Act." |
14 | (c) To administer, in consultation with the Department of |
15 | Public Welfare, job training programs authorized under the |
16 | following: |
17 | (1) Section 403 of the Social Security Act (49 Stat. 620, 42 |
18 | U.S.C. § 603). |
19 | (2) Section 115(d)(1)(A) of the Personal Responsibility and |
20 | Work Opportunity Reconciliation Act of 1996 (Public Law 104-193, |
21 | 21 U.S.C. § 862a(d)(1)(A)). |
22 | (3) The Community Services Block Grant Act (Public Law |
23 | 105-285, 42 U.S.C. § 9901 et seq.). |
24 | (4) Section 2508.3 of the act of March 10, 1949 (P.L.30, |
25 | No.14), known as the "Public School Code of 1949." |
26 | (5) Article IV of the act of June 13, 1967 (P.L.31, No.21), |
27 | known as the "Public Welfare Code." |
28 | (6) The act of July 13, 1987 (P.L.332, No.62), known as the |
29 | "Project Independence Act." |
30 | Section 2. The following acts and parts of acts are repealed |

1 | insofar as they are inconsistent with the addition of section |
2 | 2210.2 of the act: |
3 | (1) Section 2508.3 of the act of March 10, 1949 (P.L.30, |
4 | No.14), known as the Public School Code of 1949. |
5 | (2) Article IV of the act of June 13, 1967 (P.L.31, |
6 | No.21), known as the Public Welfare Code. |
7 | (3) The act of October 22, 1986 (P.L.1452, No.143), |
8 | known as the Pennsylvania Adult and Family Literacy Education |
9 | Act. |
10 | (4) The act of July 13, 1987 (P.L.332, No.62), known as |
11 | the Project Independence Act. |
12 | (5) Chapter 29 of the act of June 29, 1996 (P.L.434, |
13 | No.67), known as the Job Enhancement Act. |
14 | Section 3. This act shall take effect in 60 days. |
