AN ACT

Amending Title 51 (Military Affairs) of the Pennsylvania

2

Consolidated Statutes, providing for employees of State

3

veterans' homes.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 51 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 712.  Employees of State veterans' homes.

9

(a)  General rule.--Notwithstanding any other provision of

10

law, individuals employed to provide medical, nursing,

11

therapeutic, recreational or other care or services for

12

residents at a State veterans' home operated by the department

13

shall not be considered members of the classified service for

14

purposes of the act of August 5, 1941 (P.L.752, No.286), known

15

as the Civil Service Act, regardless of the nature of their

16

positions.

(b)  Veterans' preference.--Veterans' preference in

appointments to positions covered by subsection (a) shall be

2

accorded by the department in accordance with Chapter 71

3

(relating to veterans' preference).

4

Section 2.  The addition of 51 Pa.C.S. § 712 shall not

5

abrogate, annul or modify a collective bargaining agreement

6

entered into prior to the effective date of this act or affect

7

the classified service status or appeal rights of employees

8

described in 51 Pa.C.S. § 712(a) who were employed prior to the

9

effective date of this act.

Section 3.  This act shall take effect in 60 days.
