| AN ACT |
| |
1 | Amending Title 51 (Military Affairs) of the Pennsylvania |
2 | Consolidated Statutes, providing for employees of State |
3 | veterans' homes. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 51 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 712. Employees of State veterans' homes. |
9 | (a) General rule.--Notwithstanding any other provision of |
10 | law, individuals employed to provide medical, nursing, |
11 | therapeutic, recreational or other care or services for |
12 | residents at a State veterans' home operated by the department |
13 | shall not be considered members of the classified service for |
14 | purposes of the act of August 5, 1941 (P.L.752, No.286), known |
15 | as the Civil Service Act, regardless of the nature of their |
16 | positions. |
17 | (b) Veterans' preference.--Veterans' preference in |

1 | appointments to positions covered by subsection (a) shall be |
2 | accorded by the department in accordance with Chapter 71 |
3 | (relating to veterans' preference). |
4 | Section 2. The addition of 51 Pa.C.S. § 712 shall not |
5 | abrogate, annul or modify a collective bargaining agreement |
6 | entered into prior to the effective date of this act or affect |
7 | the classified service status or appeal rights of employees |
8 | described in 51 Pa.C.S. § 712(a) who were employed prior to the |
9 | effective date of this act. |
10 | Section 3. This act shall take effect in 60 days. |
