relating to criminal background check requirements for judges to | ||
access vital records maintained by the Department of State Health | ||
Services. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 191.071(b), Health and Safety Code, is | ||
amended to read as follows: | ||
(b) The department may adopt a policy waiving the | ||
requirement of a fingerprint-based background check for: | ||
(1) a person who previously submitted to a | ||
fingerprint-based background check as a condition of licensure by a | ||
state agency; or | ||
(2) a person serving as a judge or justice of the | ||
supreme court, the court of criminal appeals, a court of appeals, a | ||
district court, a criminal district court, a constitutional county | ||
court, a statutory county court, a justice court, or a municipal | ||
court. | ||
SECTION 2. This Act takes effect September 1, 2023. |
