A BILL TO BE ENTITLED
 
AN ACT
  relating to criminal background check requirements for judges to
  access vital records maintained by the Department of State Health
  Services.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 191.071(b), Health and Safety Code, is
  amended to read as follows:
         (b)  The department may adopt a policy waiving the
  requirement of a fingerprint-based background check for:
               (1)  a person who previously submitted to a
  fingerprint-based background check as a condition of licensure by a
  state agency; or
               (2)  a person serving as a judge or justice of the
  supreme court, the court of criminal appeals, a court of appeals, a
  district court, a criminal district court, a constitutional county
  court, a statutory county court, a justice court, or a municipal
  court.
         SECTION 2.  This Act takes effect September 1, 2023.
