A BILL TO BE ENTITLED
 
AN ACT
  relating to restrictions on branch office licenses and employees
  under the Private Security Act.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter F, Chapter 1702, Occupations Code, is
  amended by adding Sections 1702.1115 and 1702.1275 to read as
  follows:
         Sec. 1702.1115.  RESTRICTIONS ON BRANCH OFFICE LICENSE. A
  branch office license issued by the board is the property of the
  board. A license holder may not:
               (1)  advertise a branch office license as the private
  property of the license holder or any other business, including an
  employee leasing firm, a temporary help firm, or a franchise
  affiliated with the license holder; or 
               (2)  sell or offer to sell a branch office license in a
  commercial transaction.
         Sec. 1702.1275.  RESTRICTIONS ON BRANCH OFFICE EMPLOYEES. An
  individual who holds a license, registration, endorsement, or
  commission issued under this chapter and who is employed at a branch
  office of a license holder is a bona fide employee of the license
  holder and may not perform, or offer to perform, a service or duty
  that the individual was hired to perform for the license holder and
  for which the individual holds the license, registration,
  endorsement, or commission as:
               (1)  an independent contractor; or
               (2)  an employee of a contractor or franchise,
  regardless of whether the contractor or franchise is affiliated
  with the license holder.
         SECTION 2.  This Act takes effect September 1, 2015.
