relating to requiring that notice of certain environmental permit | ||
applications be sent to county judges. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter D, Chapter 5, Water Code, is amended | ||
by adding Section 5.1291 to read as follows: | ||
Sec. 5.1291. NOTICE TO COUNTY JUDGE. Notwithstanding any | ||
other law, the commission shall: | ||
(1) for any notice concerning a permit application, | ||
amendment, or renewal required to be sent by the commission to a | ||
state senator or representative, send notice to the county judge of | ||
the county in which the facility applying for the permit, | ||
amendment, or renewal is or will be located; and | ||
(2) utilize an electronic means of transmission for | ||
any notice issued or sent by the commission to a county judge, | ||
unless the judge submits a request to receive notice by mail. | ||
SECTION 2. This Act takes effect September 1, 2011. |
