A BILL TO BE ENTITLED
 
AN ACT
  relating to a grant program for certain nonprofit organizations to
  distribute diapers to families.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 531, Government Code, is
  amended by adding Section 531.024142 to read as follows:
         Sec. 531.024142.  DIAPER DISTRIBUTION GRANT PROGRAM. (a)  
  In this section, "nonprofit organization" means an organization
  that is exempt from federal income taxation under Section 501(a),
  Internal Revenue Code of 1986, by being listed as an exempt entity
  under Section 501(c)(3) of that code.
         (b)  The commission shall establish and administer a program
  through which the commission, using money appropriated or otherwise
  available for that purpose, may award a grant to nonprofit
  organizations that collect, store, and distribute diapers to
  families to enable the nonprofit organizations to develop new
  infrastructure and expand services to more families in the state.
         (c)  To be considered for a grant under this section, a
  nonprofit organization must:
               (1)  have experience distributing a large number of
  diapers to families in this state;
               (2)  have sufficient warehouse space to store at least
  400,000 diapers;
               (3)  work with at least 25 entities in the target
  community to distribute diapers;
               (4)  demonstrate an ability to expand the
  organization's distribution; and
               (5)  have sufficient personnel available to distribute
  at least one million diapers in this state in a year.
         (d)  The commission shall establish:
               (1)  grant application procedures; and
               (2)  procedures for monitoring the use of a grant
  awarded under the program and ensuring compliance with any
  condition of a grant.
         SECTION 2.  This Act takes effect September 1, 2023.
