BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 382.0518, Health and Safety Code, is | ||
amended by adding Subsection (d-1) to read as follows: | ||
(d-1) The commission may not require an applicant for a | ||
permit to construct or modify a source other than a major emitting | ||
facility, as defined by Section 169 of the federal Clean Air Act (42 | ||
U.S.C. Section 7479), to demonstrate that the source complies with | ||
a national ambient air quality standard unless compliance with the | ||
standard is required for that source by: | ||
(1) the state implementation plan adopted to | ||
implement, maintain, and enforce that standard in accordance with | ||
Section 110 of the federal Clean Air Act (42 U.S.C. Section 7410); | ||
(2) the federal Clean Air Act; or | ||
(3) another provision of this chapter. | ||
SECTION 2. This Act takes effect September 1, 2011. |
