A BILL TO BE ENTITLED
 
AN ACT
  relating to a requirement that a state agency reveal the identity of
  certain anonymous complainants to the person against whom the state
  agency has initiated a contested case.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle A, Title 10, Government Code, is
  amended by adding Chapter 2010 to read as follows:
  CHAPTER 2010. DISCLOSURE OF CERTAIN
  INFORMATION BY STATE AGENCIES
         Sec. 2010.001.  DEFINITION. In this chapter, "state agency"
  means an officer, board, commission, department, or other agency in
  the executive branch of state government with statewide
  jurisdiction that makes rules or determines contested cases.
         Sec. 2010.002.  IDENTITY OF COMPLAINANT. At the time a state
  agency initiates a contested case against a person under Chapter
  2001 in a proceeding that was initiated on the basis of an anonymous
  complaint, the state agency shall disclose to the person the
  identity of the complainant.
         SECTION 2.  The change in law made by this Act applies only
  to a complaint filed with a state agency on or after the effective
  date of this Act. A complaint filed with a state agency before the
  effective date of this Act is subject to the law in effect on the
  date the complaint is filed, and that law is continued in effect for
  that purpose.
         SECTION 3.  This Act takes effect September 1, 2011.
