A BILL TO BE ENTITLED
 
AN ACT
  relating to Texas Commission on Environmental Quality adoption of a
  streamlined regulatory program for certain aggregate production
  operations.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 28A, Water Code, is
  amended by adding Section 28A.002 to read as follows:
         Sec. 28A.002.  STREAMLINED PROGRAM FOR SMALL OPERATIONS.
  (a) The commission by rule shall adopt a program to offer
  streamlined requirements for small aggregate production
  operations.
         (b)  The commission shall establish eligibility criteria for
  the program by rule.
         (c)  Notwithstanding Sections 28A.051 and 28A.053, the
  program must:
               (1)  allow the responsible party of a small aggregate
  production operation required to register under this chapter to
  register less frequently than annually; and
               (2)  establish an inspection schedule for small
  aggregate production operations that requires inspections at least
  once every five years.
         SECTION 2.  This Act takes effect September 1, 2019.
