A BILL TO BE ENTITLED
 
AN ACT
  relating to the development and maintenance of a custody
  information system for certain offenders.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 66, Code of Criminal Procedure, is
  amended by adding Subchapter E-1 to read as follows:
  SUBCHAPTER E-1. CUSTODY INFORMATION SYSTEM
         Art. 66.221.  CUSTODY INFORMATION SYSTEM. (a)  The Texas  
  Department of Criminal Justice shall collaborate with the
  Commission on Jail Standards to develop and maintain an online
  database for use by judges, prosecutors, and criminal defense
  attorneys in this state who are involved in the trial of a criminal
  offense.
         (b)  The custody tracking system shall contain, for each
  offender under the supervision of the Texas Department of Criminal
  Justice or in the custody of a county jail in this state, the
  offender's: 
               (1)  name, including other names by which the offender
  is known;
               (2)  date of birth;
               (3)  date of arrest;
               (4)  arrest charge, by offense code; and
               (5)  date of expected release.
         (c)  The Texas Department of Criminal Justice shall adopt
  rules necessary to implement this section, including rules:
               (1)  limiting access to the judicial information system
  to individuals described by Subsection (a);
               (2)  providing for the security and confidentiality of
  the information maintained in the custody information system; and
               (3)  requiring the system to be updated in real time to
  reflect the location of each offender.
         (d)  Each county jail in this state shall cooperate with the
  Texas Department of Criminal Justice in providing the information
  necessary for the department to maintain the custody information
  system.
         SECTION 2.  This Act takes effect September 1, 2023.
