relating to the development and maintenance of a custody | ||
information system for certain offenders. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 66, Code of Criminal Procedure, is | ||
amended by adding Subchapter E-1 to read as follows: | ||
SUBCHAPTER E-1. CUSTODY INFORMATION SYSTEM | ||
Art. 66.221. CUSTODY INFORMATION SYSTEM. (a) The Texas | ||
Department of Criminal Justice shall collaborate with the | ||
Commission on Jail Standards to develop and maintain an online | ||
database for use by judges, prosecutors, and criminal defense | ||
attorneys in this state who are involved in the trial of a criminal | ||
offense. | ||
(b) The custody tracking system shall contain, for each | ||
offender under the supervision of the Texas Department of Criminal | ||
Justice or in the custody of a county jail in this state, the | ||
offender's: | ||
(1) name, including other names by which the offender | ||
is known; | ||
(2) date of birth; | ||
(3) date of arrest; | ||
(4) arrest charge, by offense code; and | ||
(5) date of expected release. | ||
(c) The Texas Department of Criminal Justice shall adopt | ||
rules necessary to implement this section, including rules: | ||
(1) limiting access to the judicial information system | ||
to individuals described by Subsection (a); | ||
(2) providing for the security and confidentiality of | ||
the information maintained in the custody information system; and | ||
(3) requiring the system to be updated in real time to | ||
reflect the location of each offender. | ||
(d) Each county jail in this state shall cooperate with the | ||
Texas Department of Criminal Justice in providing the information | ||
necessary for the department to maintain the custody information | ||
system. | ||
SECTION 2. This Act takes effect September 1, 2023. |
