| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 120, Business & Commerce | ||
| Code, is amended by adding Sections 120.152 and 120.153 to read as | ||
| follows: | ||
| Sec. 120.152. ATTORNEY GENERAL INVESTIGATIVE AUTHORITY. If | ||
| the attorney general has reason to believe that a person has engaged | ||
| in, is engaging in, or is about to engage in a violation of this | ||
| chapter, the attorney general may issue a civil investigative | ||
| demand. The procedures established for the issuance of a civil | ||
| investigative demand under Section 15.10 apply to the same extent | ||
| and manner to the issuance of a civil investigative demand under | ||
| this section. The attorney general may seek an order from the | ||
| district court compelling compliance with a civil investigative | ||
| demand issued under this section. | ||
| Sec. 120.153. DECEPTIVE TRADE PRACTICE. A violation of | ||
| this chapter is a false, misleading, or deceptive act or practice | ||
| under Subchapter E, Chapter 17, and is actionable under that | ||
| subchapter. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
