relating to the approval of purchases under the supplemental | ||
special education services and instructional materials program by a | ||
public school student's admission, review, and dismissal | ||
committee. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 29.046(a), Education Code, is amended to | ||
read as follows: | ||
(a) Money in an account assigned to a student under Section | ||
29.045 may be used only for supplemental special education services | ||
and supplemental special education instructional materials | ||
approved by the student's admission, review, and dismissal | ||
committee under Section 29.048(c). | ||
SECTION 2. Section 29.048, Education Code, is amended by | ||
adding Subsection (c) to read as follows: | ||
(c) The admission, review, and dismissal committee of a | ||
student approved for participation in the program shall hold an | ||
admission, review, and dismissal committee meeting for the student | ||
with the student's parent before grant money is assigned to a | ||
student's account under the program to determine and approve the | ||
supplemental special education services and supplemental special | ||
education instructional materials that would best serve the | ||
student. The committee shall provide the student's parent and the | ||
agency the list of approved services and materials for the student. | ||
SECTION 3. This Act applies beginning with the 2023-2024 | ||
school year. | ||
SECTION 4. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
