living free from unnecessary government interference. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article I, Texas Constitution, is amended by | ||
adding Section 35 to read as follows: | ||
Sec. 35. RIGHT TO EARN A LIVING. No governmental action | ||
establishing or enforcing requirements for, imposing or enforcing | ||
restrictions on, or otherwise regulating the business activity of | ||
an occupation or profession may impose a substantial burden on an | ||
individual's right to engage in a lawful occupation or profession | ||
unless the burden is necessary and narrowly tailored to protect | ||
against actual and specific harm to the public health or safety. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 5, 2019. | ||
The ballot shall be printed to permit voting for or against the | ||
proposition: "The constitutional amendment protecting the right to | ||
earn a living free from unnecessary government interference." |
