| proposing a constitutional amendment protecting the right to earn a | ||
| living free from unnecessary government interference. | ||
| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article I, Texas Constitution, is amended by | ||
| adding Section 35 to read as follows: | ||
| Sec. 35. RIGHT TO EARN A LIVING. No governmental action | ||
| establishing or enforcing requirements for, imposing or enforcing | ||
| restrictions on, or otherwise regulating the business activity of | ||
| an occupation or profession may impose a substantial burden on an | ||
| individual's right to engage in a lawful occupation or profession | ||
| unless the burden is necessary and narrowly tailored to protect | ||
| against actual and specific harm to the public health or safety. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 5, 2019. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment protecting the right to | ||
| earn a living free from unnecessary government interference." | ||
