| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article VII, Texas Constitution, is amended by | ||
| adding Section 7 to read as follows: | ||
| Sec. 7. (a) The board of trustees of an independent school | ||
| district or the governing body of a charter school is responsible | ||
| for decisions regarding the health and safety of the district's or | ||
| school's students and staff. | ||
| (b) The legislature or a state agency may not withhold | ||
| funding from an independent school district or charter school | ||
| because of a decision made by the board of trustees or governing | ||
| body of the district or school to halt in-person learning due to | ||
| concerns for the health and safety of students or staff. | ||
| (c) The legislature may not pass a law that arbitrarily | ||
| disregards the health and safety of public school students or | ||
| staff. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 2, 2021. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment protecting the health | ||
| and safety of public school students and staff." | ||
