A BILL TO BE ENTITLED
 
AN ACT
  relating to banning the possession and use of expanding ammo;
  creating an offense.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 46, Penal Code, is amended by adding
  Section 46.16 to read as follow:
         Sec. 46.16.  UNLAWFUL AMMO. (a) It shall be unlawful for any
  person to use or possess any expanding bullet.
         (b)  Any person found in violation of this section shall be
  guilty of a Class A misdemeanor.
         (c)  In this Section, "expanding bullet" means any
  projectile designed to expand or fragment upon impact.
         (d)  Subsection (a) does not apply to:
               (1)  Law enforcement officers, members of the military,
  or other persons authorized by law to possess expanding bullets in
  the course of their official duties; or
               (2)  The possession of expanding bullets for scientific
  research or educational purposes, provided that the possession is
  authorized by law.
         SECTION 2.  This Act takes effect September 1, 2023.
