A BILL to amend the Code of Virginia by adding in Chapter 2 of Title 54.1 a section numbered 54.1-206, relating to Department of Professional and Occupational Regulation; application review timelines.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 2 of Title 54.1 a section numbered 54.1-206 as follows:

§54.1-206. Application review timelines.

A. Each regulatory board within the Department of Professional and Occupational Regulation shall adopt a timeline of each stage that a completed application for licensure, certification, or registration will undergo as it is reviewed by such board.

B. Within 30 days of receipt of such application, the regulatory board shall:

1. Approve the application; or

2. If the board determines with reasonable certainty that there are grounds to deny the application, (i) notify the applicant in writing of the potential grounds for denial, (ii) request from the applicant all of the documents that the board reasonably believes will be necessary to make a decision regarding such application, and (iii) inform the applicant of his right to be heard and to provide relevant evidence to support his fitness for licensure. Such application shall be reviewed by the date of the next board hearing, unless the next board hearing is within 30 days, in which case it shall be reviewed by the date of the following board hearing. A board motion to deny an application shall in no case be made later than six months after the date of receipt of such application.
