FLOOR AMENDMENT EXPLANATION
The amendment does the following:
- Applies the 1,000-foot residency restriction to the victim only and not the victim’s immediate family.
- Allows a victim’s parent or guardian to consent to the offender living within 1,000 feet if the victim is still a minor.
- Establishes an affirmative defense to prosecution if the offender established residence without knowing the victim’s residence and then moved within 30 days of receiving actual knowledge of the victim’s residence.
- Clarifies that it is a violation of the statute when the offender establishes residence and continues to reside at the property.
