AN ACT

 

amending Title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-118; relating to educational institutions.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-118, to read:

START_STATUTE15-118.  Educational institutions; state law violations; penalties

A.  If the attorney general determines that any educational institution that receives state funding is in violation of state law or the Constitution of Arizona, the attorney general shall provide notice of the violation to that educational institution by certified mail.  If the attorney general determines that the educational institution has failed to resolve the violation within sixty days, the attorney general shall notify the state treasurer, who shall either withhold ten percent of the annual state funding that the educational institution would otherwise receive in the current fiscal year or direct the educational institution to return, within thirty days, up to ten percent of the state funding that the educational institution would otherwise receive in the current fiscal year.  

B.  Monies withheld from an educational institution pursuant to subsection A of this section may not be returned to the educational institution until that educational institution is in full compliance with state law or the Constitution of Arizona.

C.  Notwithstanding subsection B of this section, five percent of the monies withheld from an educational institution pursuant to subsection A of this section shall be permanently withheld from the educational institution for the current budget year and returned to the state general fund for each thirty-day period that the educational institution is out of compliance with state law or the Constitution of Arizona.  END_STATUTE
