AN ACT

 

AMENDING TITLE 41, CHAPTER 7, ARTICLE 1, ARIZONA REVISED STATUTES, BY ADDING

SECTION 41-1108; RELATING TO THE LEGISLATURE.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 7, article 1, Arizona Revised Statutes, is amended by adding section 41-1108, to read:

START_STATUTE41-1108.  Legislators required to vote unless excused; loss of salary

A.  Each member of the legislature shall vote on all roll call votes relating to third reading and final passage of a bill, memorial or resolution unless the member has a personal financial interest in the question as prescribed by the rules of the house of representatives or senate or unless the member is excused from voting pursuant to the rules of the house of representatives or senate or by the speaker of the house of representatives or the president of the senate.

B.  At the end of each regular session of the legislature, the secretary of the senate and the chief clerk of the house of representatives shall tally the number of times a member of each appropriate body of the legislature fails to vote on any bill, memorial or resolution as provided for in subsection A and is not excused from voting pursuant to subsection A.  If the number calculated pursuant to this subsection is more than five per cent of the total number of roll call votes relating to third reading and final passage of a bill, memorial or resolution, the member shall forfeit five per cent of the member's legislative salary.  The secretary of the senate and the chief clerk of the house of representatives shall deduct this amount from the remaining pay periods for that legislator on a pro rata basis.
