AN ACT

 

amending title 28, chapter 16, article 3, Arizona Revised Statutes, by adding section 28‑5813; relating to commercial vehicles.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 28, chapter 16, article 3, Arizona Revised Statutes, is amended by adding section 28-5813, to read:

START_STATUTE28-5813.  Manufacturer's base retail price; commercial vehicles

A.  In this article, the Manufacturer's base retail price for a commercial vehicle with a gross vehicle weight rating of more than twenty‑six thousand pounds is the net purchase price of the vehicle minus any taxes and fees for the initial retail purchase of the vehicle.  The Purchase price of the vehicle may be obtained from any of the following:

1.  A copy of the purchase invoice.

2.  A copy of the lending contract.

3.  A letter from the dealer or manufacturer.

B.  For retail sales other than the initial retail sale of a commercial vehicle with a gross vehicle weight rating of more than twenty‑six thousand pounds, if the department is not able to determine the original purchase price for the retail sale of the vehicle, the department may use an average retail value from information in the NATIONAL automobile dealers association official used car guide or a similar publication.END_STATUTE
