AN ACT

 

Amending title 40, chapter 2, article 1, Arizona Revised Statutes, by adding section 40‑211; relating to the corporation commission.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 40, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 40-211, to read:

START_STATUTE40-211.  Voice over internet protocol; internet protocol enabled services; definitions

A.  Notwithstanding any other law, the commission may not regulate, directly or indirectly, the entry, exit, rates, terms or conditions of voice over internet protocol service or internet protocol enabled service.

B.  Subsection A of this section does not:

1.  Affect or modify any entity's obligations under sections 251 and 252 of the communications act of 1934, as amended by the telecommunications act of 1996 (47 United States Code sections 251 and 252), or any right granted to an entity by those sections.

2.  Affect or modify any commission jurisdiction over intrastate switched access rates, including the implementation of federal law with respect to intercarrier compensation.

3.  Affect, modify, expand or limit the assessment of 911 emergency service taxes or universal service fees.

C.  For the purposes of this section:

1.  "Internet protocol enabled service" means, other than voice over internet protocol service, any service, functionality or application that uses internet protocol or a successor protocol and enables an end user to send or receive a voice, data or video communication in internet protocol format or a successor format.

2.  "Voice over internet protocol service" means any service that meets all of the following:

(a)  Enables real time, two‑way voice communication originating from or terminating at the user's location in internet protocol or a successor protocol.

(b)  Uses a broadband connection from the user's location.

(c)  Permits a user to receive a call that originates on the public switched telephone network and to terminate a call to the public switched telephone network. END_STATUTE
