AN ACT

 

amending title 28, chapter 3, article 21, Arizona Revised Statutes, by adding section 28‑1207; relating to photo enforcement systems.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 28, chapter 3, article 21, Arizona Revised Statutes, is amended by adding section 28-1207, to read:

START_STATUTE28-1207.  Speeding; speed limit determination

a violation of article 6 of this chapter or of a city or town ordinance for excessive speed that is detected by a photo enforcement system may result in a traffic ticket and complaint only if:

1.  Within sixty days after the effective date of this section and at least every two years thereafter, this state or a local authority conducts a speed test on the street where the photo enforcement system is operating to determine the speed limit at which at least eighty‑five percent of the vehicles are traveling.  The test must be conducted as follows:

(a)  On a Tuesday, Wednesday or Thursday between the hours of 9:00 A.M. and 3:00 P.M.

(b)  Using road tubes for traffic counting to determine the speed of each vehicle except for A vehicle that is traveling within ten seconds of the vehicle in front of it.

(c)  In accordance with the department's speed study guidelines.

2.  the posted speed limit on the street where the violation occurs is the same as or greater than the speed limit that is determined pursuant to paragraph 1 of this section.

3.  The local authority submits to the department for review the test results, including the number of vehicles, the time and date the test is conducted and the speed of the vehicles. END_STATUTE
