An Act

 

amending title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-120.05; appropriating monies; relating to education.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-120.05, to read:

START_STATUTE15-120.05. High school sports; automatic external defibrillators; cardiac emergency response plans; rulemaking; definitions

A. Notwithstanding title 36, chapter 21.1, article 3 and section 15-161, beginning August 1, 2024, each public and private school in this state that provides instruction to students in any of grades six through twelve and that sponsors an athletic team or sports program shall:

1. Provide an automated external defibrillator at each school campus and school-sponsored athletic event.

2. Ensure that each automated external defibrillator provided pursuant to paragraph 1 of this subsection is all of the following:

(a) in an unlocked location that is accessible during the school day and during any school-sponsored athletic event.

(b) In a location from which the automated external defibrillator may be retrieved and used at the school or any school-sponsored athletic event in three minutes or less.

(c) Identified with appropriate signage.

(d) Maintained in good working order and tested according to the manufacturer's GUIDELINES.

3. Require each coach to complete a state-approved course that provides instruction in cardiopulmonary resuscitation, first aid and the use of an automated external defibrillator and that follows emergency cardiovascular care guidelines.

B. Notwithstanding section 15-161, each public and private school in this state that provides instruction to students in any of grades six through twelve and that sponsors an athletic team or sports program shall:

1. On or before september 1, 2024, consult with local emergency medical services personnel to develop a written cardiac emergency response plan to address how the school will respond to a cardiac event during the school day or at a school-sponsored athletic event. The school shall include in the plan specific provisions for each site at which a school-sponsored athletic event may occur and ensure that the plan is consistent with nationally recognized, evidence-based standards. The cardiac emergency response plan adopted pursuant to this paragraph shall identify all of the following:

(a) Each site at which a school-sponsored athletic event may occur.

(b) Each school employee who is assigned one or more RESPONSIBILITIES under the cardiac emergency response plan, including the chain of command among the employees.

(c) Each health care professional who may provide medical services during school-sponsored athletic events.

(d) All equipment and supplies that may be needed to respond to a cardiac event during a school-sponsored athletic event, including the physical location of each item at each site identified pursuant to subdivision (a) of this paragraph.

(e) Procedures for responding to a cardiac event during the school day or at a school-sponsored athletic event, including:

(i) Responding to the cardiac event.

(ii) Calling 911 or other local emergency medical services personnel.

(iii) Assisting emergency responders.

(iv) Informing the emergency responders of the location and type of automated external defibrillators that the school has provided pursuant to subsection A of this section.

(v) Documenting all actions taken by school employees or other individuals during the cardiac event.

2. Distribute the cardiac emergency response plan developed pursuant to paragraph 1 of this subsection to all employees who are involved in school-sponsored athletic events, including health care professionals who may provide medical services during the school day or at a school-sponsored athletic event.

3. Annually review, update and practice implementing the cardiac emergency response plan developed pursuant to paragraph 1 of this subsection.

C. In consultation with the department of health services, the department of education shall adopt rules and guidelines for implementing this section. The rules and guidelines adopted pursuant to this subsection shall include procedures for the department of education to evaluate whether school districts, charter schools and private schools are complying with the requirements prescribed by this section.

D. A school district or charter school may accept gifts, grants, donations and in-kind donations for the purposes of this section, including to purchase and maintain automated external defibrillators and to provide the required training to school employees.

E. For the purposes of this section:

1. "Automated external defibrillator" has the same meaning prescribed in section 36-2261.

2. "School-sponsored athletic event":

(a) Means an event related to a sport or other activity in which students participate as individuals or as members of a team.

(b) Includes scheduled practices, trainings and competitions.

3. "Training" has the same meaning prescribed in section 36-2261. END_STATUTE

Sec. 2. Appropriation; department of education

A. The sum of $________ is appropriated from the state general fund in fiscal year 2024-2025 to the department of education for implementing section 15-120.05, Arizona Revised Statutes, as added by this act. 

B. The department shall distribute monies appropriated pursuant to subsection A of this section to schools in which fifty percent or more of the students are eligible for free or reduced-price lunches for any of the following:

1. Purchasing and maintaining automated external defibrillators as defined by section 36-2261, Arizona Revised Statutes.

2. Purchasing cardiopulmonary resuscitation training kits.

3. Providing the state-approved course for coaches required under section 15-120.05, subsection A, paragraph 3, Arizona Revised Statutes, as added by this act.

4. Other goods and services identified by the department of education that are necessary for implementing section 15-120.05, Arizona Revised Statutes, as added by this act.
