An Act

 

appropriating monies to the department of health services.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Appropriation; department of health services; mental health services for minors; intent; rulemaking; exemptions

A. The sum of $________ is appropriated from the state general fund in fiscal year 2023-2024 to the department of health services for mental health services for minors.  The department shall distribute the monies to mental health care providers who provide mental health treatment to persons under eighteen years of age in this state, regardless of whether the person is insured or uninsured, to help defray the costs of the person's mental health treatment needs that would otherwise go unmet.

B. The department of health services shall adopt rules to carry out this act.  Notwithstanding any other law, for the purposes of this act, the department is exempt from the rulemaking requirements of title 41, chapter 6, Arizona Revised Statutes, for one year after the effective date of this act.

C. The legislature intends that the appropriation made in subsection A of this section be considered ongoing funding in future years.

D. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
